how are the EG contracts designed to allow EG to stop him playing in tournaments and not paying him salary for a month. Obviously their contracts have a article like "dont hurt your team with stupid comments" but it was a "private" chat. So they don´t giving him money that he deserves. Is this a US thing because in the EU there is no way to get away with that on an employee contract. | ||

A lot of employees are bound by a creed of ethics on how they are to behave outside their profession. Take teaching professions. In some districts (different states in the US are divided up into different school districts, each district having their own curriculum, standards, and rules for both teachers and students) teachers can't be seen engaging in behavior that would hurt the schools image. This could mean public drinking, going to clubs, or having sex with students. This is easily enforced because when you want a job, you will most likely sign a contract. This contract, depending on the State, can be enforced easily or heavily. Since EG can easily be seen as a brand rather than an e-sports team, sponsorships mean everything to them. Another important thing to note is that EG is located in New Mexico, which I believe is a right to work state meaning that employers could fire you at will with little to no notice. But EG seems like a stand up employer, they pay their employees decent salaries and seem overly fair when it comes to situations such as this. I'm sure EG has a very simple publicity contract stating that players are not to engage in behavior that might hurt EGs image, such behaviors include racial remarks or sentiments, acts of violence, etc etc. This is pretty standard protocol for a lot of jobs that require public appearances and images. If you hurt your employers image because of your antics, they will punish/fine you. You're being pad to represent and promote EG, not to be awesome at starcraft which is just a side benefit. Many professions, such as lawyers, journalists, engineers, nurses, and doctors abide by a rule of ethical guidelines and indeed some of these professionals have their own committees that are known to expel people from practicing their profession. Think of disbarring lawyers from practicing law. Or terminating medical licenses for malfeasance and neglect. Many countries have committees such as these for different professions. | ||

Probably a breach of the employment contract There is no doubt a clause regarding player conduct and Stephano knew or should have known talking to other professional players over battle.net carries the risk of your conversation being streamed live. It's even quite possible that he knew it was being streamed. I'm not an expert on contract law, but I'm fairly confident that, for instance, all professional athlete contracts include such clauses. Of course the exact terms may vary, but this kind of clauses are especially important when the other party is still a teenager (stephano). The purpose of the clause is to deal with situations that can potentially lead to reputational damage. Suspension without pay when there is an expressed or implied contract term allowing that is perfectly normal. | ||

Edit: Stephano is the only reason I even watch Starcraft II tournaments, nowadays. Without him, every tourney is bound to end up with a Korean top 5 (or even top 10). If I see that Stephano isn't participating in a tournament, I don't even bother watching it. It was a god damn joke. I don't get how it's funny, or anything, but he didn't know that it was showed on stream. It wasn't his intention to hurt EG. EG are hurting themselves by doing this. | ||
