didn't go thru the link n whatnot but i would assume this was in the united states? in which case the kid would go to jail, even if the school only gave him a 3 day suspension, cops don't care what the school does. and even so, expelling him from school will do alot more damage, and thereby hopefully he would understand the wrong in his actions more clearly, than putting him in a holding cell for a couple of hours/having assault charges on his record that will go away in a couple years anyways.
I hate to break it to you but the police force doesn't have the manpower to be involved in every school fight...
this depends entirely on where you live, small town usa the cops will arrest everyone they can to make as much $ as they can, where as big city's, you're right, there simply aren't enough cops to arrest them all, or holding cells, as much as they (establishment/justice system) would love there to be.

Not quite. Hate crime law itself makes no distinction between people: it simply says that crimes committed for reasons of perceived differences are worse than those that aren't. In other words, it does exactly the opposite: punishes people for committing a crime against those that you think are different because you think they are different.

Ug this hate crime designation is nonsense. The crime is the beating up of the person, not what the bully thought. If someone beats me up because I'm white that makes it worse than because he is sadistic? Makes no sense. Where do the lines stop? Ss it only racial, gender, and sexual orientation? No, it doesn't work that way at all. If you killed someone who is straight, and I kill someone who is gay, they're both murder. If I killed the gay student BECAUSE he's gay, then it's a hatecrime. It doesn't matter who the crime is committed against, it matters WHY they committed the crime.
Also, if you kill someone straight for being straight, that's also a hatecrime.
It's a question of intent.

You clearly missed the point about it not automatically being a hate crime if its towards a minority. Its just as discrimination, but on a broader(worse) scale. If you kick someone out of your restaurant just b/c he wheres a t-shirt with a sportteam you dont like, and if you kick someone out of your restaurant b/c he is black... which one is worse? The law is there to make sure that we dont tolerate doing bad things to people just for being different.

Wait, what was a reaction to perceived sexual harassment? Who's sexually harassing who? Who's reacting? Are you implying that perhaps the kid getting beat up by the bully was sexually harassing the bully and thus the assault?
Cause the video clearly shows that the kid was asking him "why are you doing this?". With multiple witnesses. And the guy has bullied him before for his sexual orientation. All of which is documented and mentioned as such in the video.

Motive is already a factor in determining the severity of a crime. Society decided that hate towards a particular group is one of those motives that merits extra punishment.
Wanting someone else's property is not a crime. But if you kill someone to get it it still counts as an aggravating circumstance.
