If you read in my thread http://www.teamliquid.net/forum/viewmessage.php?topic_id=107279 I got arrested for possession of a drug paraphernalia even though the item was found in my friend's vehicle. It was found in the front passenger seat but it was in a walmart plastic bag. I want to fight the charges because the only reason that the police charged me with it was i did not want to talk to them. My friends talked and they were not arrested. Feel free to send me a pm

I don't see why you made the thread if you were expecting comments like "Shitty deal.", "I got arrested last year for that too.", etc.
On topic though, I don't know any more about these legal issues than you do.

On a related note I would like to thank Officer Wang for pulling me over on my way home last night. He asked me if i was drinking. I replied I dont drink. He asked where I was coming from. I said my girlfrineds ouse. He said thats great, but where does she live. I said Palo Alto He asked where I was headed. I said home. He said thats great, but where do u live. I said Santa Clara. He asked how fast I thought i was going. I said 70. He said thats too fast. I said, but i was behind you and u slowed down to pull me over. He said I can go as fast as I want. I don't want to derail this thread into uncomfortable territory but I have a bit of experience in these matters. I'd say the best case scenario would be to get a lawyer. However, even for a case like this it would cost you ~$1000 even for a moron in a suit. IMO it's not worth it but it's up to you of course. It depends on whether you've already told your parents, want to tell your parents, and whether or not your parents can afford it and/or care enough. A more realistic option would be to meet with a lawyer for a free consultation. All consultations are free. Your case sounds like complete bullshit so if the lawyer's a nice enough guy he might even get your case dismissed for you no charge if he knows the judge well enough. However, I live in New York and drug charges like this aren't taken too seriously, so don't get your hopes up.
After that your best bet is to meet with your District Attorney personally. You'll probably have to wait in line for a very long time but it will certainly be worth it. Feed him a lot of bullshit and agree to submit drug tests for as long as he wants (almost certainly won't be longer than 6 months). Make sure to bring a lot of documentation in support of your character. Print out your report cards and shit and make sure to let him know that you're a student athlete or that you're on the debate team or whatever (don't lie however). Another option to consider if you have health insurance is to get a drug evaluation and comply with their demands. This would entail involving your parents though. Anyways, don't be too honest at your evaluation as there's literally no point, it doesn't really sound like you have a problem. Say you use at parties occasionally or something. They'll probably only want urine screens over a ~6 month period, in my experience less, but again, I don't want to get your hopes up and legal systems definitely vary quite a bit over this vast, fucktarded, nation.

You are guilty by association. The fact that your friends got off has nothing to do with it. I checked the details of your charges in the other thread and it says you're getting off with a misdemeanor. Take that and leave it. It won't be on your permanent record. A lawyer will seriously cost you so much it's not even worth it.

The charge for paraphernelia sounds like bullshit. Challenge them to find proof that you've ever bought it. Obviously i'm not a lawyer but if you can't provide a receipt/check and your friend can i'm pretty sure there's absolutely no way they can charge you with it.
Also you should be happy you got a misdemeanor.

Also you should be happy you got a misdemeanor. what? that's like getting caught with drugs in general and saying PROVE THAT I BOUGHT IT, I GOT NO RECEIPT. and the friend isn't going to go "oh shoot he don't got a receipt but i do". what is going to make the police accept the excuse that you "can't provide a receipt/check".
and yes there's absolutely a way they can charge him with it. they found him with it. in a car. and from the sounds of it he refused to cooperate with their questioning.

ya i know....funny asking TL for advice. I only commented on the misdemeanor staying on ones record for 7 years. Since i had one. And if i recall correctly it stayed for 7 years....or maybe it was 5 idk lol.

Find a lawyer your parents know or something and just call them. You want to know all of your options and a lawyer will help you with that.
Also, ask about getting deferred judgment, which will get the minor misdemeanor that your charge probably is taken off of your record after a year.
