i think it's likely CA rewrites the laws/ implements policies to make it clear that crisis pregnancy centers are... call it, one of several options for dealing with unexpected pregnancy. the SCOTUS ruling is sufficiently narrow to allow for alternative state-level mechanisms. SCOTUS ruled on a free speech issue (in a way that i'll buy, though i'd disagree) and i think there's very reasonable and compelling ways to make legislation that makes the underlying situation not a free speech issue.

To be clear, I am ok with the court taking a strict line with not involving the president's statements when it comes to an injunction on an executive order. But if they adopt that same stance when hearing the full travel ban, it will be a complete act of judicial cowardice by setting up an uncomfortable relationship between the language of the order and known intent of the executive.

With religious discrimination, it's a very important distinction whether a law incidentally discriminates or if it discriminates by design. That distinction depends mostly on intention. It's ridiculous to think the arguments made for a policy when enacting it are irrelevant to the intentions behind the law. If the state legislature had said on the record "let's ban peyote to fuck with Native Anericans' rituals" the case would presumably have come out differently.
What's most ridiculous in all this though is that the administration is getting credited with a huge "win" just for narrowly, controversially crafting a policy that isn't a violation of the constitution. It's still an atrocious policy, prejudiced in its conception and incompetent in its execution. In January of 2017, its proponents were arguing they had to act immediately, without warning, so the bad guys wouldn't have a chance to rush in before it was enacted. By their own reasoning, then, what's even the point now? The boogeymen have had more than a year to find a way in by now anyway.

this really feels like just another front of the trade war trump is eagerly pursuing. i don't think anyone in the global community is inclined to listen to trump at this point. he can demand all he wants but it will fall on deaf ears, the US is quickly becoming both diplomatically and economically isolated.

The conservative bloc of SCOTUS has made clear that unless an order/policy explicitly states in its text that it is racist/based on race, that it, therefore, is not racist/based on race. Makes defending racists and racist policies easy as hell. Blueprint is there, so expect to see more.

Yeah, by your logic we should invalidate the Civil Rights Act because Lyndon Johnson said racist things. Please. The civil rights act was passed by congress and didn’t invoke the vague specter of National Security as a justification. This is an executive order created by a president who openly advocated for a Muslim ban. His lawyers were on TV saying the president told them to make a legal Muslim ban. This is not a vague racist statement said with no relationship to the legislation at hand, but a clear statement of intent through tortured legal reasoning. It would be a malpractices of justice of the court threw that out. The conservative bloc of SCOTUS has made clear that unless an order/policy explicitly states in its text that it is racist/based on race, that it, therefore, is not racist/based on race. Makes defending racists and racist policies easy as hell. Blueprint is there, so expect to see more. It would be funny if it wasn't so sad.
Yeah. I would remind folks that the majority of the Jim Crow laws did not overtly reference black folk. They were designed to be neutral and existed for "safety" reasons. They were still god damn racist.
