The Trayvon Martin shooting in Sanford, Florida, will likely be one of the most important domestic civil rights / criminal law issues in the United States this decade. It raises issues of alleged racism, alleged police incompetence / indifference to the rights of African-Americans, the appropriateness of recent criminal legislation regarding self-defense (specifically the “Stand Your Ground” law that was enacted in Florida in 2005), alleged media bias / misreporting and numerous other issues.
These are important issues that must be discussed. Such issues make or break politicians, lead to social policy changes and lead to changes in criminal law and procedure. However, please discuss these issues civilly and inform yourself of the issues before making knee-jerk reactions. The previous thread was closed due to circular arguments and country bashing. Please don’t allow this thread to go the same route. B-29: A nurse on an Alzheimer's ward who is black or Hispanic, has several children, is married and lived in Chicago at the time of shooting. She said she doesn't watch the news, preferring reality television: "Right when we got here, I got cable... I love my reality shows." During jury selection, she said she was arrested once in Chicago.
B-76: A white, middle-aged woman who said Zimmerman had an "altercation with the young man. There was a struggle and the gun went off." Has been married 30 years, and is unemployed. She formerly worked with her husband in his construction company. Her 28-year-old son is an attorney in Seminole County. She also has a daughter, 26, has been a victim of non-violent crime and rescues "a lot of pets."
B-37: A middle-aged white woman who has worked for a chiropractor for 16 years and has many pets. She described protests in Sanford as "rioting." Her husband is an attorney. She has two daughters: A 24-year-old dog groomer and a 27-year-old who attends the University of Central Florida. She used to have concealed weapons permit, but let it lapse. Her husband also has one.
B-51: A retired white woman from Oviedo who has a dog and 20-year-old cat. She knew a good deal about the case, but said "I'm not rigid in my thinking." She has been in Seminole County for nine years, is unmarried and has no kids. She previously lived in Atlanta, and used to work in real estate. She also ran a call center in Brevard County which she said had 1,200 employees.
E-6: A young white woman and mother who used to work in financial services. She used this case as an example to her two adolescent children, warning them to not go out at night. She has lived in Seminole County for eight years, and is married to an engineer. She was arrested in Brevard County, but said she "was treated completely fairly." Her husband has guns.
E-40: A white woman in her 60s who lived in Iowa at the time of the shooting. She heard national news reports and recalls the shooting was in a gated community and a teenager was killed. She described herself as safety officer, is married to a chemical engineer and loves football. She has a 28-year-old son who's out of work. She said she's very well versed in cell phone technology, and has been a victim of crime.

She has two daughters: A 24-year-old dog groomer and a 27-year-old who attends the University of Central Florida. She used to have concealed weapons permit, but let it lapse. Her husband also has one.
B-51: A retired white woman from Oviedo who has a dog and 20-year-old cat. She knew a good deal about the case, but said "I'm not rigid in my thinking." She has been in Seminole County for nine years, is unmarried and has no kids. She previously lived in Atlanta, and used to work in real estate. She also ran a call center in Brevard County which she said had 1,200 employees.
E-6: A young white woman and mother who used to work in financial services. She used this case as an example to her two adolescent children, warning them to not go out at night. She has lived in Seminole County for eight years, and is married to an engineer. She was arrested in Brevard County, but said she "was treated completely fairly." Her husband has guns.
E-40: A white woman in her 60s who lived in Iowa at the time of the shooting. She heard national news reports and recalls the shooting was in a gated community and a teenager was killed. She described herself as safety officer, is married to a chemical engineer and loves football. She has a 28-year-old son who's out of work. Trayvon Benjamin Martin (February 5, 1995 – February 26, 2012) was the son of Sybrina Fulton and Tracy Martin. He was 17 years old, 6' 3" and weighing 140 pounds at the time of his death. Martin lived with his mother and older brother in Miami Gardens, Florida. He had transferred from Miami Carol City High School during his sophomore year to Michael Krop Senior High, where he was a junior. His English teacher, Michelle Kypriss, reported him as being "an A and B student who majored in cheerfulness." and said that he "was not a violent or dangerous child" and "not known for misbehaving". He hoped to become an aviation mechanic. He was visiting his father and his father's fiance, Brandi Green, at her rented townhome in Sanford, Florida, on the day he was killed, after being suspended from school for 10 days. Zimmerman was born in Virginia on October 5, 1983, and is the son of Gladys Zimmerman, who is from Peru, and Robert Zimmerman, Sr., who had served in the U.S. military. He lived in Manassas, Virginia until the early 2000's. He was licensed to carry a firearm, but it is unclear if he had informed the homeowner association that he would be armed as a volunteer. The police report states that they attempted CPR, paramedics arrived and continued CPR, finally declaring him dead at 7:30 p.m. Statements by the police say Zimmerman had grass on his back and his back was wet. Zimmerman was bleeding from the nose and the back of the head; subsequently his lawyer stated that Zimmerman's nose was broken. However, the police report does not indicate that Zimmerman required medical attention. Multiple investigations are ongoing. On March 20, the FBI and the Justice Department announced that they were opening investigations into the incident. The state governor, Rick Scott, has asked the Florida Department of Law Enforcement to investigate the shooting. A Seminole County grand jury will also investigate the case, and will convene on April 10, 2012 according to State Attorney Norm Wolfinger.
Florida Attorney General Pam Bondi made a statement March 20 on the case:

Three out of the five members of the Sanford city commission, including the Mayor, passed a motion of no confidence in regards to the police chief Bill Lee, and his handling of the case. One member of the council, Mark McCarty, then asked for Lee to step down. Self-defense laws in the United States, particularly regarding justifiable homicide, vary by state. Florida law, as of 2005, includes a "stand your ground" provision, under which a person can use deadly force if they reasonably believe it is necessary to do so to prevent death or great bodily harm, in most circumstances. In many states, such laws protect people in their own homes, but Florida's version extends the no-retreat premise to vehicles and public places. Before passage of the law, Miami police chief John F. Timoney called the law unnecessary and dangerous in that "[w]hether it's trick-or-treaters or kids playing in the yard of someone who doesn't want them there or some drunk guy stumbling into the wrong house, you're encouraging people to possibly use deadly physical force where it shouldn't be used." Since its passage, shooting deaths with claims of self-defense have nearly tripled.
Durell Peaden, a member of the Florida Senate until 2010 and one of the authors of Florida's "Stand Your Ground" law, said that based upon his understanding of what happened, Zimmerman should be prosecuted. According to Peaden, the law does not say that a person has a right to confront another. “The guy lost his defense right then," said Peaden. Culpable negligence is a course of conduct showing reckless disregard of human life, or of the safety of persons exposed to its dangerous effects, or such an entire want of care as to raise a presumption of a conscious indifference to consequences, or which shows wantonness or recklessness, or a grossly careless disregard for the safety and welfare of the public, or such an indifference to the rights of others as is equivalent to an intentional violation of such rights.
The negligent act or omission must have been committed with an utter disregard for the safety of others. Culpable negligence is consciously doing an act or following a course of conduct that the defendant must have known, or reasonably should have known, was likely to cause death or great bodily injury.
§ 782.07, Fla. Stat.
To prove the crime of Manslaughter, the State must prove the following two elements beyond a reasonable doubt:
1. (Victim) is dead.
Give 2a, 2b, or 2c depending upon allegations and proof.
2. a. (Defendant) intentionally committed an act or acts that
caused the death of (victim).
b. (Defendant) intentionally procured an act that caused
the death of (victim).
c. The death of (victim) was caused by the culpable negligence of (defendant).
The defendant cannot be guilty of manslaughter by committing a merely negligent act or if the killing was either justifiable or excusable homicide:
Negligence:
Each of us has a duty to act reasonably toward others. If there is a violation of that duty, without any conscious intention to harm, that violation is negligence.
Justifiable Homicide:
The killing of a human being is justifiable homicide and lawful if necessarily done while resisting an attempt to murder or commit a felony upon the defendant, or to commit a felony in any dwelling house in which the defendant was at the time of the killing. § 782.02, Fla. Stat.
Excusable Homicide:
The killing of a human being is excusable, and therefore lawful, under any one of the following three circumstances:
1. When the killing is committed by accident and misfortune in doing any lawful act by lawful means with usual ordinary caution and without any unlawful intent, or
2. When the killing occurs by accident and misfortune in the heat of passion, upon any sudden and sufficient provocation, or
3. When the killing is committed by accident and misfortune resulting from a sudden combat, if a dangerous weapon is not used and the killing is not done in a cruel or unusual manner.
§ 782.03, Fla. Stat.
Give only if 2a alleged and proved.
In order to convict of manslaughter by act, it is not necessary for the State to prove that the defendant had an intent to cause death, only an intent to commit an act that was not merely negligent, justified, or excusable and which caused death.

To “procure” means to persuade, induce, prevail upon or cause a person to do something.

3.6(f) JUSTIFIABLE USE OF DEADLY FORCE

b. In good faith, the defendant withdrew from physical contact with (assailant) and clearly indicated to (assailant) that [he] [she] wanted to withdraw and stop the use of deadly force, but (assailant) continued or resumed the use of force.
Force in resisting a law enforcement officer § 776.051(1), Fla. Stat.
A person is not justified in using force to resist an arrest by a law enforcement officer, or to resist a law enforcement officer who is engaged in the execution of a legal duty, if the law enforcement officer was acting in good faith and he or she is known, or reasonably appears, to be a law enforcement officer.
Give if applicable.
However, if an officer uses excessive force to make an arrest, then a person is justified in the use of reasonable force to defend [himself] [herself] (or another), but only to the extent [he] [she] reasonably believes such force is necessary. See § 776.012, Fla. Stat.; Ivester v. State, 398 So. 2d 926 (Fla. 1st DCA 1981); Jackson v. State, 463 So. 2d 372 (Fla. 5th DCA 1985).
In some instances, the instructions applicable to §§ 776.012, 776.031, or 776.041, Fla. Stat., may need to be given in connection with this instruction.

If the defendant [was not engaged in an unlawful activity and] was attacked in any place where [he] [she] had a right to be, [he] [she] had no duty to retreat and had the right to stand [his] [her] ground and meet force with force, including deadly force, if [he] [she] reasonably believed that it was necessary to do so to prevent death or great bodily harm to [himself] [herself] [another] or to prevent the commission of a forcible felony.
Define applicable forcible felony from list in § 776.08, Fla. Stat. that defendant alleges victim was about to commit.
Presumption of Fear (dwelling, residence, or occupied vehicle). Give if applicable. § 776.013(2)(a)-(d), Fla. Stat.
If the defendant was in a(n)[dwelling] [residence] [occupied vehicle] where [he] [she] had a right to be, [he] [she] is presumed to have had a reasonable fear of imminent death or great bodily harm to [himself] [herself] [another] if (victim) had [unlawfully and forcibly entered] [removed or attempted to remove another person against that person’s will from] that [dwelling] [residence] 64 [occupied vehicle] and the defendant had reason to believe that had occurred. The defendant had no duty to retreat under such circumstances.
Exceptions to Presumption of Fear. § 776.013(2)(a)-(d), Fla. Stat. Give as applicable.
The presumption of reasonable fear of imminent death or great bodily harm does not apply if:
a. the person against whom the defensive force is used has the right to be in [or is a lawful resident of the [dwelling] [residence]] [the vehicle], such as an owner,
lessee, or titleholder, and there is not an injunction for protection from domestic violence or a written pretrial supervision order of no contact against that person; or
b. the person or persons sought to be removed is a child or grandchild, or is otherwise in the lawful custody or under the lawful guardianship of, the person against whom the defensive force is used; or
c. the person who uses defensive force is engaged in an unlawful activity or is using the [dwelling] [residence] [occupied vehicle] to further an unlawful activity; or
d. the person against whom the defensive force is used is a law enforcement officer, who enters or attempts to enter a [dwelling] [residence] [vehicle] in the performance of [his] [her] official duties and the officer identified [himself] [herself] in accordance with any applicable law or the person using the force knew or reasonably should have known that the person entering or attempting to enter was a law enforcement officer.
If requested, give definition of “law enforcement officer” from § 943.10(14), Fla. Stat.,
§ 776.013(4), Fla. Stat.
A person who unlawfully and by force enters or attempts to enter another’s [dwelling] [residence] [occupied vehicle] is presumed to be doing so with the intent to commit an unlawful act involving force or violence.

If you find that the defendant who because of threats or prior difficulties with (victim) had reasonable grounds to believe that [he] [she] was in danger of death or great bodily harm at the hands of (victim), then the defendant had the right to arm [himself] [herself]. However, the defendant cannot justify the use of deadly force, if after arming [himself] [herself] [he] [she] renewed [his] [her] difficulty with (victim) when [he] [she] could have avoided the difficulty, 65 although as previously explained if the defendant was not engaged in an unlawful activity and was attacked in any place where [he] [she] had a right to be, [he] [she] had no duty to retreat.
Reputation of victim. Give if applicable.
If you find that (victim) had a reputation of being a violent and dangerous person and that [his] [her] reputation was known to the defendant, you may consider this fact in determining whether the actions of the defendant were those of a reasonable person in dealing with an individual of that reputation.
