Regardless on if you actually did do the homework, the fact is professors and teachers get this kind of shit all the time and you will get absolutely nowhere trying to blame them. If you ask for partial credit chances are they will either be nice and let you have an extension on the deadline for full credit, grant you the chance to get partial credit, or give you an alternate assignment for extra credit. Take what you can get.

I don't know why you would ask for partial credit if you KNOW you handed in an assignment and if it's the prof's fault. Yeah profs aren't dumb, they probably hear a lot of bs stories, but if you have a ridiculous average anyway and are a good student, chances are you handed in your shit, and they'll believe you. Asking for a bit of a mark when you would have otherwise gotten close to full otherwise makes it seem like you're just fishing for marks because you fucked up. If he sticks with it, he'll get it. If the prof refuses, I'm sure he can go to the Dean and demonstrate that he's a good student and that he should not be penalized. My only advice is to be nice to the prof, or they may hold a grudge against you.
This happened to me as well, but in Canadian history in highschool. I had witnesses too that I had handed in this dumb report and I had the highest mark in the class, so it wasn't like I was some dumbass, but the bitch still didn't believe me even though she was useless. I don't even know if I got the marks but I kept bugging her about it and I think she ended up having a worse impression of me.
So yeah, if you know you did the work and handed it in, then fight for your mark, but be nice about it. Asking for partial marks would be like a suspect asking for a reduced jailtime sentence.
