But a better comparison would be to say that blizzard was the owner of a racetrack... then somebody comes a long and wants to set up a tournament on the racetrack, and money is involved in the tournie. Ofcourse the tournament arrangers would have to get permission from the racetrack owners. contracts dont matter if they're illegal in the first place. And no, a track isnt owned by me, while the software is. It would be like paying for a track day and then finding out you cant wager your buddy whos gonna go around faster because of a racetrack owner whim.

If I remember correctly; according to EULA, we are not the "owner" of the game, Blizzard is the owner and grant rights for us to play their game. Same to B.net.

You own the right to use the software for your own personal use. Its the same with a CD or a movie. You have to ask permission before you want to use it on a different scale. Thats why you cant compare the game with a car. Its fully legal to licence software and limit its use. So I used a racetrack as comparison as you own the right to race around the track for fun on your own, and as much as you want. But if you want to set up a tournie on the track you have to ask the owner.

You don't own Sc2. when you make your purchase, you are licensed it. Blizzard just doesn't want Sc2 to be associated with a scam tournament that's run badly. (not that HDH is run badly, Bliz just needs to rule out the possibility of bad PR)

It's legal. | ||

They are upheld, or torn down on a case-by-case basis in courts.

Especially since SC2 is more of an online service that you log onto with a client... and not really an object you own. i think how much pain and suffering RIAA is enduring with piratebay(which is a blatant intellectual property theft) is a good example of why i'm leaning this way.

I'm not saying their EULA is not upheldable, i'm saying that they don't own the idea of tournaments. I don't think any court would support a company trying to monopolize(somethign thats illegal in and out of itself) a complimentary product that they didnt invent or own.

They are not claiming they own the idea of tournaments. Just tournaments using their product. There is nothing close to being illegal here.

Oh well, they know they can get away with it, because we're too distracted by their video games to take notice of how badly their fucking us over > ![]() You own a license to play the game, and the disks it came on. Blizzard owns Battle.net, and if you're running a tournament on Battle.net, they're perfectly within their rights to require licenses for that. After all, the sponsors paying the prize money are using Blizzard's hardware and software to promote their products. If you wanted to have an offline competition where everyone shows up with their own computers and does like speedruns of single player missions, I'm sure you wouldn't need a license. EDIT: Also, don't be so quick to demonize Blizzard just because the "main" reason for the delay is the licensing. I'd imagine that two inexperienced guys trying to organize a 64 player tournament and all the scheduling involved in that is just as big a culprit. EDIT 2: On September 10 2010 18:07 Sfydjklm wrote: I'm not saying their EULA is not upheldable, i'm saying that they don't own the idea of tournaments. If you want to make the HDH a tic tac toe tournament then you have a point. This is more akin to American Idol having to pay licensing fees for music before they can broadcast their competition (which features other people's music). No one requires a license for an amateur tournament that you hold. But if there are tens of thousands of dollars in prize money and sponsorship deals involved, then Blizzard very rightfully deserves to control what people do with their software and their service.
