even if he is gay he is still a men and not a fragil gril he should have defend himself better and even to strike back when you know that the other one is bigger and stronger helps and it has nothing to do if he is gay or not if you can show that you have teeth like a tiger the bullies think twice before or they harras you | ||

Hundreds of kids get beaten up every day, and kids have been getting beaten up since the beginning of time. Whether it was because the kid was "different" or what have you, it's always been happening. Either learn to defend yourself, grow some thicker skin, or this will continue to happen. Not being insensitive, it is unfortunate that it happened, but it's not news at all. | ||

however, if they truly believed it was a hate crime, the kid should have pressed criminal charges and tried for the elevated criminal punishment. if the state can prove it in court then stiffer penalties can be implemented. in this circumstance, the offender receives his constitutional protections and the state can punish the shit out of him after respecting those protections. i also think that any battery should be subject to the stiffer criminal penalties if the victim feels it is justified; not just hate crimes. lastly, to prevent the inevitable backlash, hate crimes should be severely punished, including those based on homophobia. | ||
