Complexity have stated they have no desire to keep Stephano if he doesn't want to be there. The legal action will be directed at Millennium, as a matter of principle for the development of eSports as a valid industry.

Thats totally wrong. Verbal agreements can be binding in the US.

You can't sign a legally binding contract under the age of 18.
GLHF lawsuit. Nice new account. He's 18 since March.

Lot's of people can always say that a contract is "badly" written or it has "no value" but what I can say is that our contract very clearly spells out what we will provide and what is expected from the player. So maybe the focus should be on if someone understands the offer and accepts the offer and then signs the contract, that is probably a tad bit more important than if some clause that is necessary for a French contract is missing.
The intention of a contract is for an offer and acceptance as well as all that is required of both parties and I can safely say that our contract spells all of that out very clearly. There is no doubt that he was getting what he asked for and he should have had no doubt what he was asked for in return. I spoke to him for weeks and answered all questions. So sure we could all spend our lives focusing on something that is not worded correctly or something that is "missing" because I can assure you there is probably not a "perfect" contract out there. The more important issue is did he know what he was being asked to do and did he know what he was receiving in return and did he subsequently sign the contract and agree to the terms as they were? And the answer in this case is absolutely.
If Jason Lake was a lawyer then he would understand that things MUST be worded correctly and clauses CANNOT be missing. You are dealing with international law and employment law and to not have a contract written or reviewed by a professional who deals with these matters is irresponsible.
This contract is key and from the sounds of it the Col case is about as paper thin as that contract must have been.

My question is simply what do "teams" have as legal standing when dealing with international law? The chance of recourse when wronged seems to be slim at the very least. Without any semblance of a "governing body" there really doesn't seem like any real way to resolved multi national disputes. Ultimately it seems to come down to people doing the right thing which rarely is done.
In my mind I am thinking that the people who run the bigger tournaments/leagues can ban/blacklist players who are in violation of contracts, but that opens a dangerous door.

Live report : Llewellys said that coL statement about stephano "contract" being one of the biggest in term of money, is completely wrong, it's not even remotely close to what a guy like HuK has signed

Technically you can, with parental consent.

What also bugs me is that Millenium isn't looking out for Stephano's best interests. Here is a kid with a chance to travel the world, including the Mecca of StarCraft, hone his skills, and get paid a lot of money to do it, and they talked him out of it? What on earth. That's just terrible to do as a human being.

Oh my god, I know image macros are frowned upon, but that is just too perfect. Youtube Chuck Testa for anyone who doesn't get it. Wait, whats that mean? Forgive me but I'm not too tech savvy, I posted the pic the only way I knew how.
Meme's in general, and image memes (i.e what you'd find on memebase etc) are not really acceptable on TL, but anyway

So many new 1 post accounts from France arguing in Millennium's favor...

I hope coL gets a green light and support from the "eSports leaders" and sues Millenium for ignorance concerning the matter.
I second coL's decision which is more inclusive and getting the opinions of other eSports leaders is a great idea. Important to get all the facts though, strength of case, and consult lawyers.
This could eventually lay the foundations for a Worldwide SC2 organization (not exactly like KESPA but similar) which could be good for the competitive scene.

Even though it may be null in France it isn't in the US, and Complexity can sue then in a US court. Then it gets all crazy because of where it holds validity and if Complexity shows and if Millenium appears or not. Can get super nasty and make life hard for Millennium personal and players in the US, where some major tournaments taker place.
|
Come on coL you tried to screw Millenium and got screwed back and any law pursuit in France will fail. Get over it and stop saying that this isn't over or that the whole esport scene will be behind you and it'll be felt world-wide.
Deal with it.
