But when he made the remark that their newborn baby must be fathered by her ex-husband, he said she immediately stopped. "She said, 'I got something for your — —,' and walked away," Gray said. "I knew exactly what she was going to do." Gray said she went to the garage, to her truck, to get her gun and then returned back inside the home. He said the garage door that she claimed was inoperable worked for him earlier that morning and later that day with no trouble. "When she came back inside, the first thing I saw was her putting one [a bullet] in the chamber," he said. Gray said by the time his kids had come to his side to leave, she had the gun pointed at him. "As soon as I took my eyes off Marissa, that's when I heard the gunshot," Gray said. He said he never looked back, grabbing the children and running out of the house and down the street. Alexander was charged with three counts of aggravated assault with a deadly weapon. A judge denied her immunity in a Stand Your Ground hearing in 2011. In March a jury took just 12 minutes to find her guilty. Because of Florida's "10-20-Life" statutes, she was sentenced to the mandatory term of 20 years. During the news conference, State Attorney Angela Corey addressed U.S. Rep. Corrine Brown's accusations that race was a factor in the case. Corey said Brown's statement that no blacks have ever had the benefit of immunity is completely false. Alexander has maintained her innocence, saying she was trapped and had no choice but to fire a "warning shot" at an abusive husband. Gray said he lied during an initial deposition when he said he had been the aggressor because the couple had settled their differences and gotten back together. He said he didn't want to see his wife go to prison. It was after Alexander assaulted him again less than five months later that he decided to no longer support her. She pleaded no contest to domestic battery in that incident and was sentenced to time served. Gray has been arrested twice in Duval County on domestic abuse charges, one resulting in a conviction and a sentence of probation. Alexander also had filed an injunction for protection against Gray. They filed for a divorce last month. Otherwise, you're obligated to give the mugger all your belongings and the keys to your house and car the second time around - also, the mugger is allowed to kill you without you defending yourself if you can't get a person to sign off and promise to witness you shoot him. Makes perfect sense. | ||

And wrongful death is a lot easier to obtain than a guilty verdict, regardless of self defense laws and lack of direct witnesses. Edited to add: As explained to me by a police officer (and I live in Florida) during a class in college, before Stand Your Ground was even floated - "The thing I should see if you are going to state self defense is only front entry wounds, and you doing CPR on the corpse when I arrive on the scene." | ||
