If I am famous and I have a daughter(and she is also in the spotlight like Eve), I would definitely expect her to be photoshop by some kid and that kid is probably jacking off to her picture every night. But the less obvious but important thing is, I and a lot of people on TL understand that you have to expect that from the internet if you are famous. Jessica doesn't. And ironically, her job requires her to understand these "internet culture"

she is not famous. it was the first time she was on internet tv. and the fact that many celebrities dont pursue any criminal or civil legal consequences against photoshoppres (partly because many of them are just fans that are trying to be funny and not people that try to defame someone by posting faces into pornographic material) does not mean that there is a general waiver of rights for all people around the world against such actions.

Careful. Do you own, or have a valid license, to use the copyrighted photograph of a famous person? How about the pornographic picture? If not, then there's at least one person out there who can sue you (btw, good luck with your fair use defense on that one...) -- and possibly more.

the real question to me is: in south korea, is it impractical to punish people who to go the extremes of publicly defaming others over the internet? it is in the US. we have to adopt a "get tough lol" policy here, because it's about the only thing we can do as a defense, imo at least.

do you know what the great thing about defamy is ? as long as you dont feel offended its no breech of law. if you do feel offended however it is a criminal act. thats why its required by law that the person getting defamed by another person to take action and demand a criminal procedure. thats basically what slayers eve and kimgayeon did. they just pursued their own rights that were given to them by the korean constitution and by the korena criminal code.

For some reason society thinks its okay to say / harass / make abusive comments about people online. Korea is a very wired country where the internet is taken very seriously (huge fanclubs/antifan clubs). There have been cases of acid being thrown at people or poison etc due to hate groups. It's a very different beast than American internet communities which are spread out, Korea is a very dense country and the internet is taken more seriously. I think its admirable she is protecting Eve, even if it brings more attention, it's good that she is charging people for any abusive things they do online.

People are human and some people can take the internet as a joke, but honestly most don't. It's also hard to understand until you have your photograph and insults spread everywhere online.

Yeah Korean Internet is much more closely tied to the person, that's why they use the term netizen. IIRC it's almost always tied to a Korean Social Security Number etc.

So basically, Jessica brought it on herself by stating the reasons of Eve being picked up and making it such a big deal and so public. I don't remember when they announced any slayers member being picked up to the public; especially a person with no accomplishments.

If I recall correctly, there was a case of a celebrity commiting suicide because of people cyberbullying her 'facebook/myspace.' (not sure if there were more but there has been one that I clearly remember. It was quite a while ago.)

She(I mean the celebrity im refering to) may have dealt with it poorly, but it was the cyberbullying that went too far.

But Im thinking because of this prescedence, the issue is so sensitive in korea that slayers_jessica is trying to make a stop to it before it gets out of hand (you may argue that she is escalating the situation unnecessarily though.But yes, internet people get out of hand reallllly fast :/ )

even in the uk or in the rest of europe defamy is punished much stricter.

do you know what the great thing about defamy is ? as long as you dont feel offended its no breech of law. if you do feel offended however it is a criminal act. thats why its required by law that the person getting defamed by another person to take action and demand a criminal procedure. thats basically what slayers eve and kimgayeon did. they just pursued their own rights that were given to them by the korean constitution and by the korena criminal code.

Getting offended is not illegal, nor it's protected by any laws. This isn't defamation, this is disregard-able at worst and funny at best. They most certainly aren't required by law to take action in this case.

As for Korean libel laws and Korean internet freedom, we've raised concerns over that previously in this thread. Not everything written in law is logical or sensible.

I wouldn't do such a thing in the first place. I never was for Eve joining SlayerS. I am merely supporting Jessica for her actions against the trolls who did the cyber bullying done to Eve.

there are still no grounds for personal insults. the criticism of the decision of kim gayeon might be justified. but there are limits (at least in legal systems outside of the US) of how you can express those.

if your way of criticism is to post photoshops with slayers_eve on pornographic material i doubt that it fits into the category of justified criticism and is more a criminal defamation per se.

it does not concern the DA or me or anyone aside of the public of korea and the politicians if the korean criminal code is sensible or not

what concerns the DA is that the laws are in effect. and that they are so they are to be obeyed as long as they are not against the constitution (which i doubt)
