It's incredibly sad that incidents like this are seen as just another school fight when it seems pretty clear to me that it's premeditated assault, not two kids meeting behind the bleachers, so to say. | ||

The reason being that a "Hate Crime" usually implies that the reason why the victim was assaulted is due to something that is not in his control (in this case his sexuality). Its sort of a murky topic, and I'm having trouble finding the exact words to describe it. But basically, if I were to compare it to something, it is similar to not hiring someone because they are black as opposed to not hiring them because they were previously a drug user. Both qualities of said person do not have to necessarily reflect on his/her character, but society frowns on forming an opinion on someone based on a quality they have no control over. So while it is fine to not hire someone because they used to use drugs, it is not okay to not hire someone because of their skin colour. IMO, the punishment shouldn't necessarily be harsher (well it should in this case, but not harsher because its a hate crime), but the kid should have to see a therapist so that he can lose his prejudice against homosexuals. | ||

Schools don't have the authority to deal with legal issues and hence if a student breaks the law they should direct it to law enforcement. There is no justification whatsoever that the school should have dealt with this instead of the police. Breaking the law is breaking the law. | ||

The first question is good, but I should point out that hate crimes are far from the only example of the same crime being punishable for different length sentences because of the motivation or the victim's identity. I don't see "hate" as a less valid thing to consider during sentencing than mental illness, official victims, extenuating circumstances, etc. So the question (imo) is - should sentencing be the same for everyone convicted of the same offense, or should juries take things like motivation into account? As for the second question - if a straight kid is beaten up for being straight, it is also a hate crime. You don't have to be a minority to be a victim of a hate crime. | ||

Edit: Also, video said he tried to defend himself. I'd suspend the kid who lost the fight as well as the kid who won. | ||

The kid was jumped and beaten on by a bigger kid with no provocation and very little resistance, and beaten mercilessly. | ||
