And to those who say that the police can't handle every fight in school, that was no goddamn fight watch the video, the gay guy had no chance and no way to prepare for that.

The student shouldn't be punished any more than if he attacked a straight student. What really bothers me about the term hate crime is that it is used basically every time a crime is committed by against a gay person or a person of another race even if you have no idea if that was a motivational factor in the crime. Kids get into fights/beat up other kids quite often, and none of them are ever thrown in prison. It is an absolutely crazy idea that this kid deserves to be thrown in prison just because it was a gay kid he attacked. If you are going to throw this kid in prison then you should be throwing every kid you beats up another kid in prison. Note that I am in no way defending the actions of the student and I have no problem with gay people. Hate crimes create a fear among many people instead of isolated incidents. People targeting others based on differences should ad hear to different punishments. You bring up a good point of proving the "hate" in hate crimes but in this case he called the kid out on facebook for nothing more than being gay. He is clearly targeting the kid because he's gay making this a cut and dry hate crime. If there was other circumstances that made the kid attack him then maybe its worth looking into whether or not its a hate crime. There are a ton of black, Latino, Asian and white kids that get in fights but aren't ruled as hate crimes because there is personal not social differences

What happens to the straight kid who gets beaten up in class? Both are equally terrible and IMHO the designation of a "hate crime" is complete bullshit because both involve hate and are equally as bad.

The problem here is that someone is allowed to commit violent crime in front of dozens of people and not be held accountable in any way just because of his age. It's a huge problem with school in general. The fact that the kid was gay is kind of irrelevant. In my opinion any kid that beats up another kid unprovoked like that should be sent off to a special school with extra security measures put in place to protect students.

This isn't a standard school fight, he had him pinned to the ground and was punching him in the face repeatedly. This could have been murder. Anyone who does this, regardless of motivation, should spend time in juvie.

So if a psycho who beats gays deserves to be expelled, suspended, beat up, or killed, the same should go for a retard gentleman that beats nerds. Seriously, I wish I could beat those hate criminals myself sometimes. But why isnt bullying nerds a hate crime?

Though there seems to be some evidence that there was. If he was beat up solely because he is gay, then it would make it the definition of a hate crime. i guess my example was a case of hate crime against non smokers! I'm saying the bully is very unlikely to have a properly formed opinion about gay people. And either way as many people already pointed out the whole idea of hate crime is stupid. That is no way to rehabilitate a person - to tell him he is sent to jail "because of a gay person." I think that will have to opposite of the desired effect of force feeding him tolerance. What should be taught is that beating up anyone is quiet wrong.

I'm perfectly fine with him spending time in juvie, but then every kid who does something like this to anyone should spend time in juvie. Lets also note that the guy I quoted say prison which is quite a bit different than juvie.

The reason this isnt a standard school fight is because bystanders not only avoid interfering but encourage the bully by at least filming it. A lot of school fights would end up like that if indifference is viewed as tolerable.

A 3 day suspension is just ridiculous. With the thing that he did, the smallest punishment he should get should be expelled from the school, and he really probably should get sent to a detention school or jail if he is old enough. A 3 day suspension would be reasonable if it was a fight, where both sides threw punches. But he just beat the shit out of a defenseless kid......
