Alright so last winter I got into some trouble for accompanying my "friend" in stealing some stuff from a kid's open car. I was young and naive at the time and I didn't even think twice about stopping him.
Well my "friend" got caught because he is just..stupid. I find out a few days later that he snitched on me so I got called in at school and the administrators talked to me and some more stuff happened. Well the kid that actually stole the stuff threw the stolen goods away. I was able to retreieve most of them and return them to the owner so the school didn't really punish me in any way. O yea did I mention that the theft took place in school? yea dumb i know... Luckily at that time I was 16 so I couldnt be tried as an adult. The whole thing cooled down after about a week or two with me not having to even go to court and I thought everything was taken care of and things just seemed to die down... (the other guy actually did go to court but idk what happened to him but I still see him at school)
APPARENTLY NOT. I recently got a text message from the guy whos car got broken into and he said that the DA finally got the court papers and that I should have received mail telling me about my court date. His parents decided to file a civil suit on me for wasting his time and causing him to mess up in school (my "friend" actually took his entire backpack too and dumped the papers everywhere).
However, I am enrolled in school under my korean name but I usually go by an american name and nobody really knows me by my real name. But there is another korean kid at my school that is actually enrolled in school as my american name and same last name as mine. So I find out that the court papers have all been sent to him and now the court date is past due.
Alright teamliquid so what should I do? Right now my parents dont have any idea of whats going on and they think that everything has been settled since last winter.
Should I just wait for the court to realize that they have the wrong "me" and just wait for the mail? Or should I tell my parents of whats going on and tell them to contact the DA.
Also apparently the kid whos trying me is selling marijuana and usually picks up at least an ounce...maybe I should just get him fucked? LOL :[
but if i did that I would feel a bit dirty..and hypocritical
what to do?
EDIT: the reason why I might consider waiting the court date out is that I am a weed smoker..haha and the later the court date, the later I get a parole officer (IF i get one that is), which would be a later drug test

Tell your parents and contact the DA, because there's no way to play off you not knowing about the papers now that you got the text message from the guy who's suing you.
Frankly, it's silly for them to be suing you. The bottom line is what really matters here. If the kid was really stupid, he probably wasn't getting good grades anyway and there really isn't a case against you messing him up (particularly because, from what you say, it wasn't you who took the backpack) and if the kid is smart, then his school performance can't be that bad, and thus they don't have a case. Under any circumstance, the school should have done something to help the kid if his papers and stuff went missing, and his performance being affected by such an incident is unlikely. Never underestimate the stupidity of the justice system, however.

I personally agree and think that his parents are taking it a bit too far.. but I did wrong and can't say much
so if I just wait it out and not say shit you think there will be consequences?

Definetly tell your parents, that is what they are for. Especially true because they have helped you on this issue before.
If you have evidence that the kid is selling dope, I would definetly release that information (in the right hands) as well.
Lying and trying to avoid problems will not help you. Once this is over you will be a better person for it, regardless of the outcome.

I actually looked through the trunk of the car but did not take anything from the car itself.. I didn't step foot into the car once but apparently it is still a felony :[

hahaha that made me laugh..well the problem is I don't think just telling someone (cop w/e) that the kid is selling drugs will do me any good... perhaps put me in a worse situation
the only real way I could get him would be to set him up and let the cops find him holding the weight..which would be pretty difficult

Probably the worst thing you can do is miss the court date, that can only get you into deeper shit. I doubt they can really get a lot of money out of you, since you basically only failed to stop the crime. Should say that you were to afraid to stop your friend because he knows martial arts/is 6 feet tall and 200 pounds/might have had a knife.
I bet the guy who your mail got sent to pissed himself so bad.

First I would suggest talking to your parents.
Legally, they don't have much of a case against you. Failing to stop your friend, and later returning his stuff does not make you the cause of his bad grades. Furthermore, if you can get pictures of him selling weed in school/school property, or anywhere that is not a private residence you can just use those pictures when you get to court. Then he could get you for more physiological stress or w/e for following him. Although if he selling in school this should be no problem.
Use them to show that he is far more likely to be doing bad in school due to drug use unrelated to you. (Insert picture here). Drug dealing is far more likely to make him do bad in school than losing his backpack papers for a while.
Also you can't get in trouble because they sued the wrong person, its not your fault, although you should get that corrected with the pictures and be like "Yo DA your representing a drug dealer." Case should be dropped.
If it still goes to court and you have no proof of him being a bad student on his own (what was his gpa/grades like before this incident.) you are pretty much safe. Just have your parents on your side and you shouldn't have any trouble.

Assuming you have a similar system to us here in Australia.... GO AND SEE A FUCKING LAWYER.
It's called Legal Aid here in Aus, and basically they will provide a free lawyer to anyone facing criminal charges, or other related matters, if the person is under 18 years of age. Surely there is something similar where you're from. Otherwise there must be a community legal centre? Public advocates? I dont know what it is called, but I'd bet my nut sack there's something out there for you.
Stop listening to this backyard DIY advice and go see a lawyer competent in your jurisdiction.

okay let me clarify some things
these were the things that were taken from the kids car:
two small speakers (not subs), his backpack with his school papers and two calculators and thats about it
here is what he claims were missing:
$100, ipod nano, and what was actually missing
of course I did wrong because I took part in being with my friend but the fact that the kid is actually trying to get some money off of me by claiming that $100 and an ipod was stolen is complete bullshit
this kid also toilet papered my close friends house and forked his lawn on halloween before the incident occured..so I never liked this guy from the start

you did f*ck up here, and you deserve to get punished. But this kid isn't exactly innocent either. You probably deserve all the trouble with the lawsuit, b/c if you hadn't done anything this wouldnt have happened. But they shouldn't be able to extract anything from you, and you can probably countersue for attorney's fees.
