This is probably accurate. Exiting the country would not be a problem - self-deportation is a yawn. However, that extra day is still an overstay and would significantly complicate any attempt to later get a visa for a longer stay, or for business purposes. Technically, I'm not sure if he would qualify for the VWP to begin with - he's in the country on business. But I am not a lawyer specializing in immigration law, nor am I in the CBP. | ||

He could potentially contact the embassy, discuss the situation and then maybe see if he can "check in" to the flight early so in essence have "left" the country since he is in the limbo side of the airport whatchamacallit area, the place where you wait for the flight after doing customs. | ||

This is based on two assumptions - 1- the Airline will let him do so, and in doing so probably violate their own operating SOP and security SOP. 2-the airport is open 24/7 - the vast majority are not. ATL is, though, and I'm going to assume that's the one in question. Further issues: 3-CBP (who is not a subordinate of the Dept of State) will process him 24 hours prior to flight. 4-TSA (who is not a subordinate of the Dept of State) will let him through the security checkpoint with a boarding pass for a different day. (Hint - No, no they will not.) | ||
