An oil executive accused of impersonating Elon Musk in an email in an attempt to solicit company secrets from Tesla wants the lawsuit thrown out because he says his impersonation wasn’t credible.

Todd Katz was the former chief financial officer of Quest Integrity, which provides services to oil and gas companies such as ExxonMobil, BP, Chevron and Shell.

In September, Tesla filed a lawsuit against Katz, claiming he set up the email address elontesla@yahoo.com to impersonate the company’s CEO and then used it to try and extract sensitive information from Tesla chief financial officer Jason Wheeler.

According to the lawsuit, Katz sent an email from the elontesla@yahoo.com account to Wheeler on 3 August 2016 requesting more detailed information about Tesla’s second-quarter financial results that were released on the same day.

“why you so cautious w Q3/4 gm guidance on call? also what are your thoughts on disclosing M3 res#? Pros/cons from ir pov? what is your best guess as to where we actually come in on q3/4 deliverables. honest guess? no bs. thx 4 hard work prepping 4 today

em”

Wheeler did not respond and instead Tesla launched an investigation to find out who was behind the email, eventually tracing the address to Katz and his employer.

Katz subsequently resigned from his position.

This week, Katz filed an objection to Tesla’s lawsuit arguing that the company’s reaction has been “over-the-top” and alleging that Tesla hacked into his Twitter in order to identify him.

The filing does not quibble that Katz sent the email but argues that “nobody who received this preposterous and grammatically deficient email ever believed it really came from Elon Musk” and as a result there was no credible impersonation and no direct injury to Tesla.

“It is clear that the email allegedly received by CFO Wheeler on August 3, 2016 was goofy, grammatically deficient communication that was not a ‘credible’ impersonation of Elon Musk in any way,” says the document, filed in the Santa Clara superior court.

The FBI is “Trumplandia,” according to an agent who spoke anonymously to The Guardian newspaper.

In a report published Thursday, multiple sources within the FBI say that deep antipathy toward Democratic presidential nominee Hillary Clinton and anger that FBI Director James Comey did not bring charges against her this summer have motivated leaks that could damage her presidential campaign.

One agent told The Guardian that many at the bureau view Clinton as the “antichrist” and are supportive of Trump.

“That’s the reason why they’re leaking is they’re pro-Trump,” the FBI agent told The Guardian.

But another FBI source disputed the level of support Trump has within the bureau, according to The Guardian.

“There are lots of people who don’t think Trump is qualified, but also believe Clinton is corrupt,” the source said. “What you hear a lot is that it’s a bad choice, between an incompetent and a corrupt politician.”

According to the report, the tensions boiled over in July when Comey declined to recommend charges against the Democratic presidential nominee for possibly mishandling classified information through her use of a private email server to conduct government business, according to the FBI agent.

Comey last week sent a letter to congressional committees notifying them that the FBI was looking at new emails uncovered in a separate investigation that could be related to the Clinton case. The FBI has come under tremendous criticism from Democrats and some Republicans for interfering with the election by releasing that information to Congress just under two weeks from Election Day.

There have been further leaks about internal fights within the FBI and other possible investigations since the Comey news broke, all of which has suggested an agency in a public war with itself.

So I'm curious, since we have a bunch of attorneys (and a paralegal) in here: how would you go about defending this dumbass if you wanted the best chance of a favorable result?

Well I guess with Clinton the Democratic party had planned it for the last 8 years and with Trump the Republicans were incapable of fielding anyone who could stop him.

Own your dumb mistake and settle. Claiming it is creditable is a reasonable argument if you straight up admit the joke afterwords. But apparently Tesla needed to go through some effort to find him and confirm he wasn't trying to do anything else.

The complaint against him is pretty weird too. I'm not sure how Tesla proves they were harmed beyond having to hunt his ass down.

Edit: Ok, I read further and it appears that Tesla had not idea it was an oil executive when they were digging into this. They thought it was some dumb shit on twitter harassing them. They hit the jackpot and decided to see what other bullshit he has been up to. This is some funny shit.

Edit 2: There are 10 other people named in the case.

Edit 3: So the attorney's argument that there was no harm done would be reasonable if Tesla had not felt the need to go to such lengths to find out who sent it. I can't believe this is a isolated event. They went ham for a reason, which will likely appear in their opposition to the motion.

these massive leaks of internal docs is a relatively new thing. it highlights drstabilizing potential of bringing private sphere of government into the open.

the intelligence value of hrc emails would be really low without this peculiar position of her being the bastion vs trump.

if she did this server thing in ten years, when this kind of damage is recognized and procedures bolstered, id say it is disqualifying. right now she has a bit of a oopsie pass in terms of anticipating harm.

also obviously given threat posed by trump holding hillary accountable for this stuff is just counterproductive. youd hope she learns not tondo it again, now that the nsa would probably agree to provide her with the blackberries she wanted

On Thursday, Radar Online claimed to have obtained an except from [Megyn] Kelly’s book “Settle for More,” which hits stands on Nov. 15. The report alleges that Kelly added details of the sexual harassment to her book, being published by HarperCollins, last minute.

In the memoir, Kelly allegedly said that she was first informed that she “captured the attention of Mr. Ailes” by her managing editor in 2005, shortly after she became a legal correspondent in Fox’s Washington bureau. From there, Ailes then apparently began summoning Kelly to his office for a series of meetings.

“Roger began pushing the limits,” reads the excerpt. “There was a pattern to his behavior. I would be called into Roger’s office, he would shut the door, and over the next hour or two, he would engage in a kind of cat-and-mouse game with me — veering between obviously inappropriate sexually charged comments (e.g. about the ‘very sexy bras’ I must have and how he’d like to see me in them) and legitimate professional advice.”

She reportedly alleges that Ailes would offer to advance her career “in exchange for sexual favors,” which she rejected. But in January 2006, Kelly wrote that Ailes tried to grab her repeatedly and kiss her, and when she rejected his advances, he asked, “When is your contract up?” The alleged harassment ended after six months, says the report, likely because Kelly reported Ailes to a supervisor.

Ailes is just the kind of guy I would pick to help me debate a woman. Ailes really knows how to get the feel, the measure, of a hostile female. Like him, I don't mind if the woman gets a little feisty when I move in on her. Trump even had the good sense to follow Ailes' advice and to stalk HRC around the stage in the second debate.

what is the difference then, judge? if trump said (and had the power to enforce) a choice between voting for him or making sure i never get a mortgage loan for the rest of my life (pretend hes a monopoly banker) would that be coerced? what if he threatened preventing my sister from getting a loan?

now imagine you hate hillary and trump and would rather vote for neither but hillary says vote for me or a fascist who will deport all muslims will take power. thats not coercion?

I know you are temp banned and cant reply but wouldn't Hillary have to actively make that last part happen if you don't vote for her in order for it to be coercion?

I feel like under your definition, if there was a fire in your area and you got a phone call to evacuate you'd describe it as being coerced to leave. The fire comes regardless of what the caller does tho...

So who are you being coerced by, reality? Life? I guess you are but it seems kind of irrelevant at that point. You either believe trump is a forest fire and vote hillary or you don't and vote something else.

I'm sorry for the bump but i wanted to reply to this last night but forgot...

So, when will an investigation about abuse of office be launched against Comey and his crooks? A federal institution should be impartial, and the past weeks have shown that they are clearly not.

Which dumbass?
