These Treyarch guys were getting paid by Activision, while surreptitiously trying to undermine the success of other Activision games, and while starting development on an EA game and negotiating with EA in breach of contract. Under Activisions terms, they could have even started a game that EA would publish, but they had to wait until a certain period of time before they could shop it to other companies. But these guys wouldn't wait for that. It's like some of the rules in sports with Free Agency periods and the like.

Trying to make some bold political statement by using such a horrid example such as Activision is a great way to get flames stirring and bring the discussion somewhere totally irrelevant. The point is Activision is a malicious company and none of us should be surprised by this. We can all show our disdain by not buying their products.

Which is exactly what I am doing, with the exception of Blizzard products. It's still sad that they are affiliated with Activision at any level, but there is nothing I can do about it.

An unanswered question, were the royalty payments etc. also part of their employment contract? If it is then Activision broke the contract and it can be considered void when they failed to make a payment owed.

I believe I read somewhere that Activision paid IW 36% or 46% of the royalty payments and held the other payment as "ransom" for them to make another CoD game. I have no idea what happened to the unpaid amount after the the shit hit the fan though.

If Activision wins, Kotick will just monopolize the market and raise prices of games like no tomorrow. The consumers will be at the losing end of the stick if Activision wins.
EA is the lesser of the two evils IMO. Kinda pissed @ Acti for doubling the price of SC2 in my country vs a regular game and Fail.net 2.0
