It's true that age isn't exactly tangible. However, I don't see how "portraying" an adult as a non-adult is any different then fantasizing. You can't go around arresting people on that kind of whim.

How do you know it was portraying her as a kid? From what we know, it was pornography that was later said to have someone who was 'underaged'... Mate this is some common misunderstanding that i hate. Pedophilia is being sexually attracted to prepubescent kid. Meaning the kids genital development hasn't reached maturity which also means she can't have babies (although there are rare anomalies).
So if you're sexually attracted to a girl who is able to bear your children, you're not a pedophile.
Keep that in mind people, pedophilia =/= sexually attracted to girls under age of consent.

The word is Ephebophile... if we're talking about the preference towards 15-19 year olds...which really isn't that big of a deal.

Silly? Yes, but anyone who insists that societies will behave entirely rationally has been smoking a bit too much of the reefer. Though, what we do as a society is not entirely without merit. Realistically, there's no clear dividing line between what should be acceptable and what shouldn't be acceptable. Different people mature at different rates both physically and mentally, but law is typically not so flexible.
Nevertheless, in my opinion there should be different dividing lines. A man who has relations with a slightly "underage" girl might not even realize she was underage and might not be doing anything wrong. On the other hand, a man who does something to a girl whose age is expressed in fewer than two digits is one sick, sick bastard.
This is beyond fucked up. I can't believe that the justice system is retarded enough to let someone spend 8 months in jail for that. I've seen "little lupe" on porn sites and shit, and yes, she looks like shes fucking 15, but honestly youd think you would check before putting someone in jail for 8 months... I would want at least 4-500k in compensation for that bullshit.
