On June 17 2021 23:34 Doublemint wrote:Obamacare survives after Supreme Court rejects latest Republican challenge via CNBC Show nested quote +The Supreme Court on Thursday ruled against Texas and other Republican-led states seeking to strike down Obamacare in the law’s latest test before the nation’s highest court.
The top court voted 7-2 to reverse an appeals court ruling that had struck down the law’s individual mandate provision.
Justice Stephen Breyer, who authored the opinion of the court, said that Texas and the other states that challenged the law failed to show that they were harmed by it. In legal terms, the states failed to demonstrate that they had standing.
“Neither the individual nor the state plaintiffs have shown that the injury they will suffer or have suffered is ‘fairly traceable’ to the ‘allegedly unlawful conduct’ of which they complain,” Breyer wrote.
The decision is a major victory for the legislation, which former President Barack Obama signed in 2010. The law has since become a crucial element of the nation’s health-care system, responsible for the coverage of tens of millions of Americans.
The decision marks the third time that Obamacare, also known as the Affordable Care Act, has survived a challenge before the Supreme Court. Defenders of the law worried that the panel, which now has a 6-3 majority of Republican-appointed justices, would scrap the legislation, which has long been criticized by conservatives.
“Each time, in each arena, the Affordable Care Act has prevailed.”“Let me say definitively: The Affordable Care Act has won, the Supreme Court has ruled, the ACA is here to stay. And now, we’re going to try to make it bigger and better.”“What a day,” Schumer added. nice one. even 3 additional Trump judges did not throw out the ACA. Show nested quote +Several of the court’s conservatives, including Chief Justice John Roberts, joined Breyer’s opinion on Thursday. The others voting with Breyer were Justices Clarence Thomas, Sonia Sotomayor, Elena Kagan, Brett Kavanaugh and Amy Coney Barrett. heads of "Conservatives" will explode. Its good that the ACA still stands but it still feels like a punt tho. This is not a ruling on the legality of the mandate, but discarded for lack of standing. So Texas can find a random citizen who is affected by the mandate, unlike the state itself, and take it on another trip to the SC.

The verdicts getting more and more conclusive (7-2) feels like them putting a pillow over the face of this nonsense. I think they are ready to move on.

The ACA is never going away and Republican lawmakers know this. They make these challenges in court to look virtuous to their base but it's all empty theater.

Yes its virtue signalling but they wont lose a moments sleep over it if the ACA gets torn down while Democrats are in charge (and therefor get blamed).
When they were in charge and it all hinged on a decision by the SC they were sweating about being left with the pile of crap in their hands
And Jan 6th kinda acutely proved the danger of 'we don't mean it, its just virtue signalling'.

The ACA affects too many lives for it to ever go away. Also, a big difference between January 6th and the ACA is the people involved. There is no unpredictable angry mob dictating what happens to the ACA.

Did they know McCain would tank it? If not, I think they were legitimately about to do it

I was talking mostly about the court cases where the politicians don't directly control the outcome and I remember anonymous reports around one of the SC decisions where Republicans were hoping it wouldn't get struck down because they had no plans how to go from there.

Do you think that we'll see in our lifetimes such a water crisis in California that the federal government will face either mass dieoffs or taking water from the Midwest great lakes?

No, I think California has so much room for improvement that it wouldn't come to that. No more lawns, no more almonds, no more golf, there's so much you cut before people are having an actual health crisis.

Isn't the water crisis already happening ? Not only in California, but in the entire US since the infrastructure is crumbling down faster and faster/

I promise you people will die before we cut out those things in CA

Sure, but after the homeless die I'm sure we'll stop that stuff.
|
Eh no one cares about the homeless, as a general rule.
Until the average person literally cannot go to work if the A/C in their car breaks down, or someone dies trying to commute to work in a car without A/C, nothing's going to change.
Edit:: I guess it might take people regularly dying during commutes for something to change, and public transit being unusable due to broken A/C.

I’m pretty sure CA would be glad to be rid of them and to have their problem “solved,” it’ll have to start having an effect on affluent people before people even think to do shit.

I'm pretty sure Nevuk was being sarcastic.

I’d like to take a moment to appreciate how much less all of us think about politics nowadays. So thankful

Hyper-fixation is a common response to anxiety. When people focus on something bad, it makes them feel artificially more prepared. It isn't healthy. There were major mental health issues created by Trump's presidency. I'm still involved and I still care, but it is important for people to give themselves a mental health break too.

There is definitely a lot less "what new bullshit will come out today" than before, so I see what you're getting at. There are still stories to follow around the world and within the US that affect a lot of people and those people are going to remain engaged more than others. There's no wrong or right way about it. Just because some of us can take a step back and breathe doesn't negate that we're still listening to what the scrum is on the street and in various forms of media. We just don't have to give it out every waking moment.
It's always important to take a step back and realign and get your mental state healthy once in a while. Neuroticism is unhealthy.
