Yeah, I think my intuition on thermodynamics is way off. 15W (if it's that much) for 60 seconds is just 900 Joules. Aluminum's specific heat capacity of 0.9 J / (g * K) at around 25 C, and some percentage of 670 grams of the tablet's mass is that aluminum back, not to mention the other materials that would heat up some as well. I don't know how much of that mass is aluminum, but if it's only 100g (it's probably more than that), then let's just say each gram needs to soak up 9 Joules each, which would mean a rise in temp of 10 C before any dissipation to the air, and even ignoring the other stuff in there. That's reasonable if start temp is 25C and their supposed skin temp target is no more than 41C.
That said, this stuff is completing 3DMark runs too. However, based on the results, it looks like the clocks are probably down some.
I blame tech journalists for being sheeplings and not packing IR thermometers and other gear to launch events.
LimeNade, take a second look at malware. Or maybe try Safe Mode just to check and see if you're still getting load then. Or both.

So I ran malewarebytes and after rebooting, everything seemed to be working fine. Been using my computer now for a few hours and even if I quit everything I have running and leave my comp alone for 10 mins it won't drop below 25% load and 3600mhz. What in the world could be using 25-50% (mostly stays towards 25% but will bounce to 50% sporadically for a little) cpu load and 3600mhz frequency with no applications open and unnecessary processes ended? Could svchost be a cause of this is anyway?

It could be malicious software. It could also be some kind of dysfunctional software or driver. I'm also still not convinced the power plan is not the issue because apart from Samsung's SSD Magician there are other kinds of "optimising" software in the internet that change these settings without explicitly telling you. So if LimeNade hasn't done so already restore the "Balanced" profile to standard settings might be helpful.
So MalwareBytes didn't find anything - you could give Autoruns from Microsoft TechNet a try http://technet.microsoft.com/en-us/sysinternals/bb963902.aspx and have a look at what programs and drivers are automatically started when Windows starts up. And see for yourself if any one of them could be the trouble maker.
If it is malicious software though you most likely will not find it listed and my best advise is format and reinstall.
Oh and from my experience these "free" antivirus software programs like AVG Free usually cause more problems than they solve. Just use Microsoft Security Essentials for Windows 7 and nothing else.

Already restored it to balance settings. I have checked programs and drivers that start when windows start and nothing there is out of the ordinary (to my knowledge). On start up things seem to be fine just things never throttle back down after I'm done doing whatever it is I am doing even while my comp is idle.

The thing is even if the energy profile is on "Balanced" the individual settings of the "Balanced" profile could have been changed by you or a software program. So when I wrote "restore the Balanced profile to standard settings" I meant make sure to use Microsoft's default settings for the "Balanced" profile. In Windows 8.1 there is an option to click that does exactly that. Don't know how things are on Windows 7.

You're looking at memory usage, not CPU usage

Found it finally ( i think ) nvidia stupid streaming service that I never use would keep poppin up for like 1 second maybe using an average cpu of 5.00 then terminate and redo it over again like a second later. Went and turned it off then went and turned it from automatic to manual. Christ maybe I can actually fall asleep now without having to think about this lol 330am here.
So far all my cores down 20 degrees from 50-60 to 30-35 and my load is at only 5% with all my crap open in google chrome. God bless you Cyro for stickin it out with the nooblets like myself lol hopefully i can help someone in the future.

EDIT: Also found taskhost is eating 20-25 of my cpu so between the two made sense why my load was bouncing close to 50 on idle sometimes. Ending the process taskhost tho after I am booted up seems to work but I am guessing I got to find whatever DLL is causing taskhost to eat up so much CPU. Can anyone recommend a good program that will allow me to see a breakdown for taskhost?

N200 is the case, it's a solid budget case. You also get a single 4 Gb RAM module with this case, which on newegg gets you an $8 discount. You can then buy that same RAM module again and get a 2x4 Gb kit at $68 instead of $72. I guess it's $4. You could almost just not buy the second RAM module and stay at 4 Gb, though that's a personal choice. I checked my system today and running steam / streams / starcraft 2 / browsers at the same time. Didn't go over 4 Gb of RAM usage (I did approach it though).
Standard HDD since SSD is kind of out the build's build, imo.

I don't know how good Athlons are, ouch, can't comment. However I can qualitatively say that Intel Haswell processors are probably better than that CPU. Games generally speaking, I know this is true for games like Dota that use the Source engine, prefer high performance in a single thread (or task). Intel is the king of single-threaded performance with their Haswell processors, so the fast i3 that I put in my build should be better for games than that Athlon. You'd have to overlock an FX processor to 4.5 GHz+ to approach Haswell single-thread performance at 3.6 Ghz. So I'm going to say that my build already has the better processor for games. On that basis alone I prefer my build.
Otherwise the N200 is also an excellent budget case, it comes with two 120mm fans and it's a wide case, which makes it nice.
The video card in that build is a bit better than the GTX 750 Ti, however it does consume more power. Given the budget PSU, I like the GTX 750 Ti better. Not to say that getting an AMD card would make your system catch on fire (the linked build also uses a budget PSU), however the AMD card consumes more power and produces more heat (heat isn't good and it also makes for a noisier system). the advantage of the GTX 750 Ti over the R9 270X is that it consumes way less power, produces less heat and it remains a strong card. The card can also overclock and get very close to the 270X's performance.
That said, the card in my build has a $20 rebate on it, you're getting a $150 card at 13% less expensive. Since it suits your needs anyway and doesn't go over budget, the 750 Ti is better in this case (though you need to go through mail-in-rebate obviously).
My build has 8 Gb of RAM, which is kind of better than 4 Gb. 8 Gb should be completely sufficient, 4 Gb can maybe limiting if you open a lot of different programs (skype, web browsers, games, steam, etc).
I'm a bit skeptical about those linked builds though, scrolling down you find a slow, locked, i5 (3.2 GHz) CPU with a Z97 board. Z97 boards are meant for overclocking generally speaking (see OP), so it doesn't make sense to put it with a locked processor that can't overclock. That build would have been better with a fast i5 4690 and a cheaper B85 board for example. The PSU in that build is also shit for such a build.
