As emotionally invested as people are on this topic, TL rules still apply. That includes flaming and ad hominem attacks. |

If you think about it, that response is more childish than the people who email sponsors.

Cool. Don't think that they will dare post the same message on their site! Though I doubt SRS can do anything to them.
After all this drama, I have to commend Destiny for not getting involved this time. Wise choice... Not the same could be said for Fayth...

He had his email password WAY WAY before to help him with lesson scheduling or whatever. Apparently he used the same password for all his stuff. How should she even magically get access to all his stuff right after she found out about that convo?
Naw TT1 and Fayth (the only people that should have known about that) confirmed that

This just seems so destructive towards him and way out of proportion. Is this really legal? o0 I'm not a lawyer, but I don't think Destiny could successfully prove a case or defamation against anyone for anything that has happened so far.
In the US, to prove defamation you must first prove that the claims made against you are false, secondly you must prove that they have damaged you, thirdly you must prove that those who made the statement did not adequately research the truthfulness of the statement. As Destiny is a public figure, he would also have to prove that the untrue statement was made with the intention of causing harm or with reckless disregard for the truth. Defamation also applies only to published statements, so letters to sponsors can only be defamatory if they are published. Statements made on an internet forum are considered to have been published for legal purposes.
Most of the complaints made about his behaviour were based solid truth - Destiny has admitted to, and been proven to have, sharing pictures of Blue Tea with his friends without her permission and whilst making negative comments about her. He has also previously used racial slurs and other objectionable language in public, and the Mia Rose incident was streamed live. Therefore, any consequences resulting from people writing or speaking about any of the above are not related to defamation of any sort.
The only untrue statement that I have seen used to tarnish Destiny is the comment about him sharing nudes from a 15-year-old child. Examination of the chatlog from which this rumor came reveals that he was sent swimsuit pics of the 15-year-old but did not solicit them and refused the fifteen-year-old's advances, and that the nudes he shared were of an adult. So allegations of recieving and distributing child pornography are demonstrably false and any damages resulting from such claims may be recoverable under defamation laws. If the defendents believed that their statements to be true at the time they were made, and a reasonable person could have arrived at the same conclusion with the same information and a reasonable amount of care taken in understanding it, then they may be protected from claims of defamations by that.
With the loss of his contract with Root and most of his sponsors, Destiny has probably taken a financial hit from this and has also taken some emotional blows and become less secure in his lifestyle. If he can show that some of this damage is linked to the false allegation of sharing indecent images of a child, then part of his losses may count as damages for the defamation claim.
Adequate research into the truthfulness of a statement can be tricky. What counts as adequate varies greatly depending on the forum in which the comments are made and the esteem of the commenter in the eyes of the target audience - journalists have more responsibility than ordinary people, as to professionals in a field relevant to the claim, amongst other groups.
The initial false claim appears to have come from several posters on reddit independently and wrongly conflating two separate incidents in the chat - Destiny revealing nude pictures of an adult without her consent or knowledge, and Destiny being sent unsolicited bikini pictures of a child by that child. These events were revealed in the same chatlog, and whether or not people had a responsibility to ensure that they had read the chatlog fully and understood the progression of events properly before posting remarks which could damage someone's reputation under names not linked to their real identities on an internet forum can be argued. The responsibility to investigate truthfulness is likely diminished in reddit comments as reddit comments are not held in esteem, and the users posting them do not generally provide enough personal information for esteem they may receive elsewhere in their lives to affect the level of trust people place in their comments.
If it is determined that the previous three elements of defamation are satisfied, then Destiny's status as a public figure means that he must prove malice on the behalf of the defendant(s). To do this he must prove that they either posted the false statements with the intention of causing harm, or with reckless disregard for the truth.
Most of the comments containing the allegations relating to the 15-year-old were corrected shortly after the poster knew them to be false, and some note that the confusion arose from skimming the chatlog and wrongly conflating the sharing of nude pictures of an adult woman without her knowledge or consent by Destiny with the unsolicited receipt of self-sent pictures of a child in a bikini by Destiny. Given this reaction to correction and the standards of truthseeking expected in a forum such as Reddit, it may be very difficult to prove malice.
He may be able to make a case about Blue Tea's misuse of his login details to gain illegitimate access to his accounts, however, and publishing indecent pictures of him. It seems unlikely given the circumstances though.

It's pretty amazing how many people are laughing because "internet justice has been served. mwahaha!"
Bluetea did something incredibly illegal, do you think she'll see full ramifications for it? I can bet she wont. Meanwhile Destiny is booted off ROOT, the one team I and many others thought would be behind him no matter what, and has his entire career put in jeopardy. Private behavior is private for a reason, and companies/teams/sponsors punishing private behavior is BS.
What do I mean? Imagine another famous player has a bondage kink, and pictures of them participating in said kink are leaked. Massive PR nightmare for what is supposed to be a private situation between very few people who trust each other. Now imagine this person played for EG, do you think EG would stand by them? I'm betting no, because the team image matters too much. It's crap.

Ok so almost 100 pages of posts to this thread now all this proves is how important Destiny really is to this community.
Also what blutea did is very illegal "Knowingly accessing, and without permission altering, damaging, deleting, destroying, or otherwise using, any data, computer, computer system, or computer network, either to devise or execute any scheme or artifice to defraud, deceive, or extort, or to wrongfully control or obtain money, property, or data." This law covers everything blutea did she may have had his e-mail PW through legit means but to use said e-mail to change PW's on both FB an Twitter is so illegal. She has openly on reddit admitted to this and it is really an open an shut case. Now how harshly will she be punished, not very is my best guess if Destiny even pursues it.
My last point I'll try an put a positive spin on this situation, Smart people do the stupidest things some times, What Destiny did a lot of men do and maybe his major lack of better judgment in such a public manner helps a lot of people think twice before they say or do anything that will affect other people this negatively some things in life are just better kept to yourself, the only true place we have freedom is in our own thoughts nowadays. That being said BMing in game is akin to a lot of the trash talk you get in major sports if the people at home heard half of what was said on the line of scrimmage people would be crying to ban football. Destiny is as popular as he is because he is who he is and never tried to hide it that deserves a little respect. The fact that hes back up an streaming through this whole mess is a testament to his strength of character and totally supports his claim of being as real as possible, real people do fuck up hes not hiding he seems to be taking his licks as well as anyone would for all you guys saying he can dish it out but can't take it. I think people can take a lot away from this whole mess its really up to the individual.

This is possible - the websites she gained access to his accounts on have a "Lost password" feature where they will send a new password to the linked e-mail if you claim to have forgotten it so long as you know the account name and/or the linked email.
I am not getting into the issue of which parts of what she did were legal/illegal and how. There is a reason I am not in law school. + Show Spoiler +It's because I enjoy having a soul. And the law library is depressing.

The difference is that he is "messing up" over and over and over again. Childhood ends when you realized that your actions have consequences and that you have to deal with those consequences. What everyone is effectively saying in defense of Destiny is "He act's like a child but at least he is proud of being a child and doesn't try to be an adult so we should respect that" No we as adults (not a community of people with a shared interest) do not need to encourage people to continue on in childhood but show them what it means to be a responsible adult.
Now yes the flammers and defamers and Destiny hatting mob are also acting childish but that does not mean that defending him is a good idea both are immature. In reality those who are his friends need to actually care about him and help him grow into maturity.

It does seem to me like she was spying on his Skype convos for a while now and that was the "leak".

Yeah the log had a timestamp. It was like 1-2 days before drama started.
And since only 3 people knew of this convo and all of them are fucked now I seriously doubt someone from that group would try to leak the log.
