I think easily obtainable weapons is the issue here, although a pocket knife really isn't that bad, larger more dangerous knives being fairly available, especially in the US, make what could just be a violent upset between adults degrade into possible deaths. And it happens a lot...

No, he actually doesn't. See, once you're the instigator, you're at fault from what follows. Thus, if Dylan punched Jorge, Jorge pulls out knife, Dylan cannot pull out knife as well and attack Jorge and not be found guilty of murder. The law does not work this way. What matters is who is instigating the matter.

You've gotta feel like shit if you're the bullies parents in this case. Not only have you failed in raising your child to not torment others. But you've lost him because of that failure. I can't believe there is a positive side painted about a bully in stories and tributes. After reading tributes and messages of love. He wasn't "slain" he was rightfully killed. He deserved it and his parents should be jailed for raising a creature like this.

After reading a fair amount of comments want to see if I can end the discussion.
It is a shame for both sides and sad that it had to escalate to this situation but it had been happening for a year. At this point it's safe to say that the other kids and teachers weren't going to intervene. The kid didn't know what to do and felt taking a knife was the best course of action.
When surrounded by a group of bullies one of which said he is going to physically harm you, the kid with the knife is very scared doesn't know what to do and will violently swing the knife as the testosterone is going and when the body is in an adrenaline state the mind becomes more tunnel visioned, one of the points that's taught in psychology.
As some TL posters are stating they have been bullied and it can be very traumatic and make them side with the bullied. It is known that scaring at a young age from being bullied or other time of abuse can lead to social problems for adults.
My last point and probably the biggest these are kids, Communication is hard if not impossible to do with them if you read all the bullying cases and previous precedent on the issue you will see that no one knew that this was happening. As a growing kid their brains are not as developed as an adult or a TL reader that thinks they know what should of happened, kids in school don't fully know how to process or resolve a situation that can be far outside their comfort zone. That is why booze isn't allowed until you are 21 because the brain needs to evolve in key area's. Their thought process is way different then anyone else that is why some kids are put into juvy not prison.

Isn't carrying a knife with you considered illegal as it falls under the category of white weapon? I'm very sure this kid would be trialed and convicted in pretty much every other country in the world for doing what he did. Self defense my ass, the only thing he would have received was a minor beating and some bruises by some bully. If the beating would end up much worse, he can just sue and reach for a nice financial settlement. But the kid was walking around carrying a knife, it's obvious some part of him wanted to exact revenge on his aggressor.

Thats right, he just brought the knife to school when he knew there was going to be a fight. I read the report, he had the knife in his pocket and used it when attacked. The law says hes innocent since its ok to kill unarmed people who threaten you.

Don't see anything wrong with this. Fighting back isn't an option when there is a group of his friends there. I was bullied in grade 6 and forced into a fight with the bully and his 18 year old brother + friends were in a group around me. I punched the kid and a bunch of people jumped me when i hit him. It's not just a fight, because they will beat the shit out of you whether you are "winning the fight" or not. And if he was being bullied for like a year then thats the reason he had the knife. durrr.
