Unfortunately, public school boards are always anal when it comes to discipline. The reality is, they don't give a shit about whether you're really guilty of anything or not. They have their reputation to protect and those in administration want to keep their jobs. As far as they're concerned, if there's any evidence (however remote) linking you to a crime, you're guilty. They have the power to do whatever the hell they want and they aren't afraid to use it. Hope you get it cleared up. | ||

So we got a lawyer, and after weeks did the school board start to budge about what the rights are of a student. The school tried to get him kicked out of all of the schools in my county. However, this is illegal as everyone is given the right to a free and public education, and no matter what, the county has to give some form of education, if online, a private tutor, or what not. What happened to you, really sucks ass. You should seriously hire a lawyer, it won't be cheap, but it will definitely help your case. Because the public education is a bitch, public schools lie to you, etc... You may find out that you have a lot more of choices and possibilities than what you are given. So, instead of being kicked out of your academy, you may be able to attend it next year, if you can prove that you weren't involved. Best of wishes... | ||

I haven't studied US law but I did some quick research on it. Public schools are governed by the Texas Education Code. School Discipline is governed by Chapter 34, and it states that removal to an alternative education program must be justified by reference to the school code of conduct. Your school code of conduct will state the circumstances in which you may be punished by removal to an alternative program, and also the conditions needed to authorize the removal. You said you 'incriminated' yourself, so what exactly did you say? I have doubts that they would have punished you if its as you say, because it seems you told them nothing at all? You should look at the school policy on alternative disciplinary programs, and see in what circumstances they were allowed to remove you. See if what you told them/did fits. Again I haven't studied US law so I suggest you see a US lawyer if you want to pursue this. | ||

Situation that is somewhat similar. If you are merely involved in a fight (including watching), you are open to the penalties. As in, I saw like.. so many of my friends get suspended because they were getting the shit kicked out of them. Let me repeat that. Person A beats up Person B, and Person C and D watch. All four get suspended, but maybe Person B is lucky and gets a fucking ice-pad as a parting gift. Schools, or most of education, for that matter, have painfully cold, and irrational standards. Makes you wonder why this is actually legal. | ||

Just a suggestion, get your teachers to back you up. If they know you're an excellent, A-earning student, they should stick up for you. That CS map thing really pisses me off. The kid did a fucking fantastic job on that map, honestly the type of work he could be paid lots of money to do with real design software. | ||
