I saw dimaga made a post on this subject over in the reddit thread describing the issue from the standpoint of someone who's team (well, now ex-team) had an agreement with own3d:

"i totaly agree with you ! for last 2012 i streamed a lot for owned near 9 months i get payed only once for first 3 months and for 6 other months i still didnt get the money. Its not totatly the same situation, cause my situation is a little bit more complicated cause of my previous team mTw becuase they had contract with Oleg (owned), and last time i talked to him and ask to send money directly to me not to team he said he cant because of contract with team. As far as i know team get some money from this 6 months(didnt pay me) but still waiting money from owned(team said if they will recived money they will transfer it to me). Anyway it still suxxx hard to wait so long for your money you already earned and spend a lot of time etc etc. And i still dont think i will get this money for that 6 months of work(streaming). T__T"

What a nutty issue.

man poor even poor dimaga is getting mistreated as well.. I cant believe we(most of us) are finding out about this now. Something definately needs to be done. If Oleg cannot run a bussiness correctly then he needs to quit and let another platform step up.

The OP needs to update with the new comments from husky, dimaga and others. Its apparent that this problem isnt only about destiny

Oh wow. I never liked Destiny, but that was just a personal thing. If this is actually happening, it's unacceptable, not to mention the HR guy or whatever seems very unprofessional. Really shady.

I have a feeling that this will make a very important impact on my life, within the next couple of years. Thank you for sharing this truth. Worth reading this thread just to read this line.

Quote so hard... just from personal experience, i have no problem with leetspeak, but would never do business with a company or group that uses leetspeak. For the exact reason that leetspeak has no purpose. On a more related topic, I really hope Destiny gets his money because whether or not I like or agree with the guy, everyone has a right to the money they have earned.

Why haven't all these people who have had their paychecks stolen by own3d.tv taken legal action against this organization? If I was any of them I would be threatening it the moment I had one late paycheck, but that's just me. Either way months of no paychecks, and zero subscription revenue? That is downright evil and ridiculous.

Very disappointing. People should seek legal action.

Obvious answer. Suing costs a lot of money, time, and involves a high degree of uncertainty, especially if own3d is still unable to pay.

Can someone tell me where all the eSports journalists were to break this story? This is actual important shit vital to the health of the scene and not a fucking peep for the many months it's supposedly been going on.

True point, even if you win a law the case, they may not pay. And then you need to spend more money force them to pay, which by that point, they may have no money. Its all being "judgment proof" in the legal field.

But the team signings? If they were reporting on this, how would they tweet who was signed to what team after leaving their old team? How would we stay informed?

Its a company based out of Austria and lawyers are not cheap.

and being in Austria, its pretty hard to pursue them legally, and they know this.

errr thats pretty contrary to what i actually learned in university. If they are a registered company in Austria and Destiny signed a contract with them as a consumer (which he should have done, obviously he didn't post the details) there are numerous laws to protect him, including one that basically amounts to, in doubt the jurisdiction lies within the living sphere of the consumer not the company.

On the other hand he might still not consider it worth it, but frankly he is probably making a mistake here. From personal experience most companies who did not meet their contracts obligation pretty obviously (and that should be VERY easy to prove considering the amount of time he says he has not been paid), get advised by their own lawyers to settle out of court long before it truly reaches a judge, simply because there is nothing to be gained if the case truly is as clear cut as he said.

Meaning he would probably have to pay about 300€ to get a lawyer to write a pretty standard lawsuit and send a mean letter.

Because Alex Garfield hates it when eSports journalists break news.

TB, that takes effort.

As for the OP, not being able to expect payment when you're guaranteed through a contract is really unfortunate. I really hope he and those having this issue switch to Twitch.

Welcome to the world of start-ups. Slow-paying, "forgetting" bills, using any and every possible thing as an excuse for delays, that's how they survive with low or negative cash flow.

Own3d and Twitch are probably being screwed over themselves by the advertisers who are supposed to be paying them.

Please do not bring US law into a discussion regarding a firm which allegedly resides in Austria. Suing someone does not involve any degree of uncertainty over here. Either someone owes you a debt you can prove, or they don't. If they do your lawyer (technically you don't need one for something like this, but let's keep it simple) has about 1h work to prepare it for court. In most cases (as in about 80% of those i worked on), the firm mysteriously decided to pay up before the court date arrived, simply because they know just as well that "Schuldrecht" is very iron clad in Austria. All they can gain by not paying (or arranging a settlement of some kind) is getting the court costs (including execution of their assets) added on top of their debt.

Destiny has a contract of some kind, and he can clearly show that he did not receive any payment from July onwards (I think, would need to reread his post), that is more than enough to sue someone without incurring almost any cost in Austria.

Nah, because this wouldn't have gotten the quick page views and would have been difficult to do. Why do the hard work when teams go through all the effort and then you just have to leak the signing information? Way easier than collecting information from 20 Owned broadcasters and writing a story about it.

I brought up similar issues, such as slow payment, incorrect fill rates, deceiving the public etc. a long time ago on my blog.
They have been around for a long time, twitch has since fixed it to the best of their ability. But things could be a lot better overall in the industry.
