Oh, definitely. There's almost nothing to be gained from a lawsuit unless someone is a lawyer (makes the process easier, although still have filing fees) and thinks they could compel any kind of action via a lawsuit. More than likely, suing them would definitely kill the Sons of Starcraft documentary, as I doubt they could possibly afford a defense if they've already spent money on the actual film.
Of course, there's a fair number of lawyers sharking around out there and I think "twisting logic into bow ties of wibbly wobbly timey wimey nonsense" is a required course and an entire section of the BAR exam, so it's a possibility no matter how remote.
I would regard any kind of money to a kickstarter campaign as exactly what it is - a donation to something I hope will get done. If I get anything out of it, great. If not, well I knew that was pretty damn probable when I gave the money. Yeah, there may be some "assurances" or such offered by the TOS but I'm not holding my breath. (This may be a bit pessimistic or fatalistic, but at least I can be pleasantly surprised when it works out positively in the end.)

As someone posted previously, the TOS specifically state that "the creator is legally obligated to fulfill the promises of their project" or give back the money. So again, I think it's kinda silly, but wouldn't the people of Kickstarter have an interest in enforcing their TOS and make sure people don't get scammed through their site?

At best they could win an order requiring a refund of their money (damages) or fulfillment of products specified. If neither the product or the money is there... they will win but the likelihood of them seeing anything out of it are slim. A lot of people can "win" in court only to never recover anything and spend more money trying to recover.

And imagine, all it would take to end this speculation is just nearly any public statement. It's a fun thing to think about, just exactly how easy it would be to stop this, that's why I can't blame people for concluding the reason for the silence is that everything has gone terribly wrong somewhere. I think the conspiracies of them using money to move to Korea are a bit tin-foily, but, with stuff like the signed posters and delays, it's pretty clear they have completely fucked up somewhere and are hiding in shame instead of fessing up or whatever. I mean it's been said several times and places on forums/reddit that they don't respond to emails or anything like that, pretty damning sign in my opinion.
We might see the documentary some day, but regardless, it's a safe assumption that we're dealing with a pretty serious case of mismanagement on a lot of fronts, both in regards to PR and the film-making itself.

I often compare the start of eSports with the start of the music industry because both began under the same circumstances. Both rose quickly based on glamour, fast sales and a cultural phenomenon. What happened? Both were immediately invaded by shysters and fools with delusions of grandeur. They took dumb kids money and ran.

It was just a bunch of people who wanted to make documentaries, but then found they were way in over their head.
This seems to be true. Most of the projects that never get completed on kickstarter are never held accountable (i.e board gaming and music). Normally what makes people fullfil their promise is the necessity of maintaining a reputation. In this case maybe tastosis would be the key player in pushing the documentary. I, for one, do think they will want to avoid this becoming a huge scam at all costs.
