Is a creator legally obligated to fulfill the promises of their project? Yes. Kickstarter's Terms of Use require creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. (This is what creators see before they launch.) We crafted these terms to create a legal requirement for creators to follow through on their projects, and to give backers a recourse if they don't. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill. I don't know too much about this project and not like i care, but it's up to you. | ||

Depending on backers jurisdictions there are many state courts that allow financial restitution for forms of economic fraud. It doesn't cost a lot of money when many States in the US have institutions dealing with this exact thing. There is also the ability to do chargebacks, depending on the payment method, the creator can face major fines from financial institutions. If this person has failed to fulfill any of the obligations/tiers in the kickstarter, he needs to be punished. You can't hide under the esports banner when you break the law. edit: also forgot to add, depending on jurisdiction this can easily be done for very little money in certain small claims courts. | ||

I certainly hope I am flat out wrong and that the documentary does get released at some point. It is just extremely unfortunate that he can't spend 5 minutes a month making a video talking to his backers at Kickstarter, the people who gave him this great opportunity to do something he loves. He claimed he wanted to be open in the process of making it, but he has been far from that since his initial release date has passed. Whether or not your lawsuit has merit may be adjudicated at some point (varies depending on jurisdiction - in a case like this, almost certainly going to be Federal due to diversity of parties) however it is STILL going to be very expensive as either the Plaintiff or Defendant. This is the fear that copyright/patent/trademark/etc trolls operate on - they send you a very threatening letter demanding that you do something (such as remove content or settle for an amount just less than an effective defense may cost) prior to even filing a suit. Because of the costs involved in ongoing litigation, this can have a chilling effect on speech and push people towards settling even if they could very easily win their case on the facts. Because the facts don't matter - they can't afford the cost of defending in a civil case. (IANAL. That's what I was getting at, actually, that a situation like this is small fish and you'll most likely still lose quite a bit of money even if you sue and win the case.
