I'm not sure that they can do that. If that's the case he can easily terminate the contract unilaterally... Anyways, I'm pretty sure, that Rubiales said that Lopetegui is no longer "employee" of the FA. I don't know where you are reading from, but both AS and Marca are reporting that he is fired.

Also, it's not exactly good for attracting high quality coaches in the future if you're preventing them from moving on for no reason.
