Apple has recently won its proxy war with Google and Andriod through its internatinal legal dispute with Samsung.
But the empire strikes back. And it wants to hit directly home. Google has filed suit directly against Apple in the U.S. International Trade Commission. The claim is that Apple's iPhone, iPad and iPod Touch infringe seven of the roughly 17,000 patents Google inherited when it bought Motorola Mobility just over a year ago.

Patent law is an amazing thing. I cannot believe apple actually went through with their lawsuit, they had to know something like this was going to happen lol. Basically, this can happen in any industry and it is essentially agreed upon that if the product isnt extremely egregious you don't go after each other.
IBM, Mercedes, etc could go after tons of people, but then were just be countersuits and everyone involved would be in litigation for decades.

They patent things so obvious and basic that they shouldn't even be able to be patented and then proceed to sue each other over stupid large amounts of money while wasting federal money getting the courts to fight over it and bring in jurors.
Not to mention the obvious appeal that Samsung is planning. Especially after several jurors revealed they pretty much went against what they were told to do.

this is very big. if you guys don`t realize, this is not only about specific features and patents, but since google phrased it as a non-standard essential, it can pertain to most of the things shared by the technology and hold them exclusive of patent which means, apple will lost everything if they lose this

I think this is one more step towards that, if Google wins and Samsung loses their appeal I think the US will have to take another good look at the way their patent system currently works and rehaul it.

From my experience, no it is not.
Also most forums aside from pro-Apple ones usually tend to dislike Apple because of the way they conduct business. A lot of the time it's misguided anger but there are some really valid points floating around.

Maybe it's all about their values at the time the negotiations took place. Motorola was only recently acquired by Goggle, and Apple has so much leverage then to make the most out of the negotiation.
Apple started it so I guess it was only a matter of time before Google responded. Kinda sucks that it has to come to this. I doubt the courts and lawyers can really get a handle on this unless they are somehow very informed on the issues.

I feel like Apple is gonna get shredded up here. They went after something very general vs Samsung. Google is targeting very little niche patents that are hard to infringe upon, and if it turns out Apple is actually infringing on all these patents, they are in for a huge loss.
Will be interesting to follow though. Sucks that stuff like this has to happen but at least it's something to pay attention to.

This isn't even being a good guy here as-is now. This is fighting dirty IMO, albeit in retaliation to stupid Apple harassment. I dislike Apple, but this move by Google improve my view on Google at all (although it's still better than Apple).
Patent law for technology like mobile phones just doesn't work. Companies buying other companies just to get their patents is not what tech companies should be doing with their time and money. What they should be doing is making cool stuff, not covering their arse in case they accidentally infringe someone else's patents.

Apple has been doing the same things in the past, and the recent win in the court didnt really take things the right way. American company vs a Korean company on American soil, with a jury that was completely clueless about the issue (at least according to the news).

I know I'm stating the obvious, but it seems the patent laws need to be reformed. I'd like to see a debate between whether ideas or implementation should be the patent-able part (In the US right now it's purely the ideas which is bad...). Perhaps both can claim a share, and if they don't mutually agree on the sharing a court decides on the % share with a penalty for the party who wanted an unfairly large portion.

What are you talking about? The judge was a Korean who had ruled against Apple in the past. You can't seriously believe that the ruling was because of bias. As for the jury, go after the judicial system if you want.

It's really all depends on the analysts. Who will recognize they are winning and will pounce on it. Depending on the strength of their case, I don't ever see the winning side do anything else but obliterate the other. I mean that will open the market wide open. The only reason that this will go to a settlement is that if both have an even chance and there is more to lose in a prolonged legal battle than in meeting halfway. As long as there are no mergers, either result is fine by me.

Patents actually give many small development firms leverage which they would never get in a world without patents.
The alternatives are copyright and trade secrets, both of which are probably more inhibitive to tech advancement.
Is anyone seriously naive enough to think that most things would be open source? Good luck getting funding and investors.
Software patents are completely different. They are 'supposed' to protect R and D but all they really do is kill competition (which is bad for customers if you didn' t know). A software copyright on the code is a much better solution, although definitely not a perfect one.
And the truth is patents own small developers face. It's the reason why many get shutdown. It seems like it might be a good idea, 'oh I got this sick idea let's patent it'. Problem is, giant companies like IBM have patents that nearly every single software program ever written infringes on. For example, I believe IBM has a patent for returning negative values as an error. This is somewhat of a staple in programming (if you didn't know).
This is only an example but there are tons of these. If you are the small guy and you get a software patent and some big guy takes your idea and you sue them with your patent, they will countersue you with their 17,000 patents you infringe on. Or if they like your idea and just want to put you out of business they can just by sueing you. You don't have the money to fight back, and you don't have the money to license their patent.
tl;dr software patents don't help small companies.

Basically, what it means to the situation is this: It's a technology/design aspect that makes a cell phone a cell phone. I'm not sure if what exact patent it is is out yet, but an example of it would be something like a cell phone antenna. Without one, you don't have a cell phone.

You can't ban someone from using a standards essential patent, because that would mean they can't adhere to the standards, which they have to. You can only make them pay you a fair price for using their patents.
For non standards essential patents you don't have to sell them the rights to use it, you can force them to drop the features entirely.

Probably when he was dying, he had a dying wish to take down these companies even if it meant to go to a thermonuclear war and Tim Cook could simply just be abiding to his final wish.
I suspect if this was true, and if Apple loses completely, then assassinations will take place afterwards.

This is going to be really entertaining. Apple opened up a can of worms with their lawsuit and they have no one but themselves to blame here for this hammer falling. Yes, Samsung has the same UI structure which is good for the user, but I've had people copied my style of apps for the appstore (not blatent copy, but he entered the nieche market using my app as a guide) and it just pissed me off, I can see why Apple is pissed off, riding on their success. But thing is I can't do nothing about it because, they infringe nothing.. which was what Samsung argument is all about.
Apple wern't the first to enter the smartphone market, they entered into a market that no one gave a crap about and showed the consumers how to do it right.. They did it with their iPads as well. Also Apple doesn't invent, don't know why people just throw the word "invent" around. I've never seen Apple used that word on their products yet it seems to be a common argument to use. My engineer teacher would always tell us a scientist always discovers and an engineer would always use the discoveries to implement it into whatever and make it viable for the consumers. Apple are the engineers in this case, they use what has already been made and use it in a way viable for consumers. That's how their buisness modal works.
Apple has patented hydrogen fuel cells that claims to have batteries lasting up for weeks before needing a recharge. Though I think we are too early to determine if it viable or not, but something like this would be massive for Apple to take advantage of.

You still missed the point. The point is that the Motorola vs. Apple lawsuit is just a other lawsuit in a dirty game that everybody is playing, not some sort of white knight move Google is doing in retaliation of Apple vs. Samsung, an assumption fueled by the "high horse Apple disdain".
It's not hard to find cases where Motorola, and by proxy Google, is suing other companies for IP patents.
Google is as dirty as everybody else, but they are pretty good at being two-faced with their "Do No Evil" mantra, which once meant something.
By the way, the first punch in this whole mess was thrown by Nokia *against Apple*, and the first blood was drawn by Microsoft against HTC.

If you carefully read the article, you will notice that the source of information is Apple's own Supplier Responsibility Report. In other words, this is Apple auditing and calling out their own suppliers' labor conditions in reports Apple makes public every year. If anything, Apple is the one that is doing something to improve working conditions, although there is still a way to go:

Well that was the case in Motorola vs Apple originally, the fact that the patent deemed to be infringed upon is simply called an "industry standard" which means that everyone must have this, however the 7 that google found are very particular and very precise, however most of the new apple products no longer use them, but instead most are made by Qualcomm I do believe. I think that somethings are bullshit and that if you can infringe on the way something zooms in (pinch method), but not something deemable as an industry standard is quite retarded. If only we could stop lobbyism, maybe something could actually be done about patent standards.

It's like this on ever forum. I said this in the last thread, but really hating people for liking a company that makes a product is foolish. People think it's cool to hate on a company or a game and rant about the same things everywhere. Every company sues and gets sued, everyone just like to dish out the hate because people like a this vs them mentality, or so it seems.
However, I blame patent laws not the company. If the company has the right to try, then why not? I have an iPhone and I like it better than the droid because it's more user friendly to me and fits me. But I don't hate the droid or people who own a droid. Same goes for people that are Windows vs Mac OS, I personally like the customer service of Apple over Windows, I understand the language and I get a person right away, but I don't hate Windows, I just have a use for it. Throwing more cents/sense into the anti-hate/non-discussable language and feeling within this thread.

Because it just ends up screwing everyone, yourself included once another big name gets fed up.
There is a history of companies who try to litigate their way to success quickly failing as a result. Apple has been going overboard trying to abuse the shit out of the patent system by suing for anything and everything. People have a right to be angry at them for doing so when all it does is stifle innovation and create nothing new (unless you count ill-will and alienating your customers as creating something new).
In any event, I hope Google shits all over them with this so that Apple is forced to either stop mass litigating or to crumble as a company.
