Also the sword seems to have a cooling of period, ie a weakness nobody that has been cut has instantly been under his power it takes them quite a while to remove all the bad memories of him and insert the good ones so it's not strange that Byakuya isn't feeling the effects yet.

If you want a real plothole. The fact that there is another substitute shinigami. Remember Rukia was going to get fucking executed for making one. So Ginjos entire backstory is pissing on the actual good part of this manga, fuck yea!
