This is ridiculous. Elections are just around the corner, and Germany's representatives decided to commit political suicide? How much are they being paid?

You are being overly optimistic if you think your shit will come here... It is basically impossible, in France at least there will be riots and manifestations everywhere. The main problem with genetically modified food is not health but the possibility for industrials to do what they want with it. It's already bad enough that with crossing, industrials have managed to create plants that need specifical fertilizers, pesticides etc... and plants that last only one year (perfect for speculation on the prices of semance)... I can't imagine what shit goes in America with food, it's like eating something you have no clue where it came from and not giving a shit about how it affects the farmers (how they become dependent on some products), the variety of products, the environment and even yourself. If industrials had put more effort into developping tougher semance and more nutritive plants hunger would be history. Anyway, letting genetically modified shit coming in Europe is letting industrials do what they want not in the name of free market (hey unofficial agreements) but in the name of greedy shareholders.

Has Monsanto actually sued over that? I cannot imagine that that would ever hold up in court (although granted: that might not stop Monsanto from suing and just trusting their deep pockets will cause the farmer to settle). Fairly certain that if Monsanto's seed were to blow into a farmer's field from a neighboring farm, the patent is not violated. Same for cross-polination.
Farmers preemptively starting a lawsuit (and it getting thrown out) is not the same thing at all.

The farmer argued that the Monsanto seeds spread through wind and Monsanto didn't contest that because that wasn't relevant to their case. The farmer intentionally selectively replanted the seeds from the plants he suspected were the Monsanto ones until his entire crop was their patented plants. They argued that the act of deliberate selective planting of their copyrighted plants broke their patent, regardless of how the initial seeds got there.

In fact, GMOs are probably the first such things in history, so it seems like this would be a grey area in the law. In any case, didn't Monsanto lose that lawsuit (or just drop it) and now they genetically modify their corn to be infertile in addition to whatever benefits it gives?
E: Kwark's situation makes it more complicated, but it essentially boils down to the same problem in patent law stemming from the novel area of reproducing patented objects.

Monsanto doesn't sue farmers for seeds that get blown it. If you want to use their seeds, you have to buy them. That's how it works. If you try to work around their patents, and essentially copy their seeds without paying them for it, you risk getting sued.

If you want to use Monsanto seeds you buy them from a Monsanto supplier. If you don't want to use Monsanto seeds don't buy them and don't try to make your own.
