Cloak banshee against an observer build doesn't put terran that much behind, relatively speaking. Banshees are faster than observers and should kill a few probes anyway. Also, it gives you tech that's gonna be very useful against colossi.
The imbalance in PvT is the relative risk that's involved for both sides. Terran has more safer options.

In fact in TvP early-scouting is more easy for toss, because stalkers taking map control and poking around, while T can't get out without maraudeurs / stim / all-ining. And yeah i know scan.... scan just scout nothing if the opponent not too stupid...

To an extent the risk/reward aspect should be alive, but there are two extremes of risk/reward; one of which is a coin-flip, the other being a game of chess. With the current scouting options, the risk/reward system is currently far too close to the coin-flip end in PvT, whereas ZvT and ZvP have a much better risk/reward balance.
