Also the DMCA takedowns are utter garbage and everyone knows it. Now that ESL used that tactic they deserve all the shit they get and even more.

They very intentionally took a extremelly vague stance, trying not to take sides. If they minded exclusivity deals they could have prevented them. "Directly competing" is a really shitty way to word things because every single stream that gathers any kind of attention will be directly competing with the event. They left a very obvious gap in their rules.

Yes, but given the guidelines valve gave, BSJ did nothing wrong by doing his broadcast, even give the vagueish language (altogether, what they DID say at the very end was quite specific)

Even though I think they obviously mean stuff like BSJ is fine, the wording is really shitty. What I don't understand is who even owns the right to the DotaTV material. If it's owned by Valve ESL shouldn't even be able to claim it. If some of it was owned by ESL, they would have to right to do anything they want, unless there were specific written rules about it.

If some of it was owned by ESL, they would have to right to do anything they want, unless there were specific written rules about it. To that end, in addition to the official, fully-produced streams from the tournament organizer itself, we believe that anyone should be able to broadcast a match from DotaTV for their audience. However, we don’t think they should do so in a commercial manner or in a way that directly competes with the tournament organizer’s stream. This means no advertising/branding overlays, and no sponsorships. It also means not using any of the official broadcast’s content such as caster audio, camerawork, overlays, interstitial content, and so on. Finally, this is not permission for studios to broadcast each other’s events. In general, everyone should play nice together, and we think the boundaries should be pretty clear. idk that terminology seems okay. tbh idk if bsj had some overlays on or something so maybe he did break that rule.

If it's owned by Valve, issuing a DMCA even if BTS restreamed it should obviously be wrong. I don't get how you can issue a DMCA of something you don't own. No matter what the wording was in the statement. This is some Kespa vs Blizzard shit though.

Because DMCA puts literally no onus or burden on the rights claimant, and while filing a counter-claim constitutes an agreement to evaluate the case in a court of law, filing the actual claim entails no such thing. It's just your average incredibly terrible piece of american law.
