At all points in time? I wouldnt be surprised if there was a small window of NDA before public keys go out (the ones distributed at random)

You're thinking of an alpha that is under NDA. Blizzard Beta's have never been under NDA, only the Alphas.

Wow wow wow, so much false information in this thread... Friends & Family Beta has been always under NDA, and it's considered as a BETA, not an Alpha.
I guess the F&F (under NDA) is already running, and they are waiting for the good time to start the Closed Beta (which includes first wave of invites, pros, casters...), apparently this week !
There was an NDA for D3, which was removed after some times, don't you remember Day[9] having issues with streaming D3 ? He was told he could stream, then not anymore, he canceled his stream etc. NDA issue.
