maybe they ment that those replays were secret and not released before the tournament were over/in a certain point?
Nope. MLG Dallas replays were released pretty soon after the tournament.

I'm pretty sure it's player based, not legality based. More of a thing of privacy.
Some players do not want their stuff cast on the (public) internet. Yes, the replays are available on the internet, but many people (such as myself) do not even know these replays exist until it's broadcasted.
Privacy is something that you don't get in Starcraft II especially considering that 2 people have access to the same replay, so I don't think the privacy thing will ever work for anyone =P. Hell, you have to give random people your first/last name just for them to be on your friend's list if I'm not mistaken.

most of the times basically it meant that the games have been played before hand and given to the official casters ( for various reasons such as integrity )

Pretty sure not all replays are released to the public actually. Some casters do get exclusive replays from tournament organizers/players.
That could be a reason. Never really thought that the tournaments would want people waiting. As far as the replays we're talking about, they are all public. They were available for download just hours after the tournament finished.
So, it seems like as long as you have a license from Blizzard, there really is no stopping you from broadcasting replays other than integrity and other player's wishes if they decide they don't want to be casted.
