On the 31st of January, through a series of cryptic clues, I announced to the SEA community that I was going to be personally sponsoring and managing a professional StarCraft 2 team consisting of players from Australia. On the 11th of February, we announced 4 of the 5 players in our line-up.
And as of today, March 8th, I'm pleased to (finally!) announce the 5th player in our roster.Although the team originates in Australia, our goals aren't SEA focused. We intend to get actively involved in the global scene, starting with a trip to America later this year. We're going to register the entire team for an MLG Open Bracket, and we look forward to once and for all dispelling the stigma that SEA players can't compete with the rest of the world.
If you'd like more information on the team, or any of the players, there are plenty of ways to keep touch with us:

Cool. Good luck
Moonglade is one of my fav zerg players, so wish him, and you, all the best
|
so are you guys sponsored by Nvidia?

Been a fan of mOOnGLaDe ever since his 4th place at IEM world championships.
Gratz and GL to the team

I was expecting him to end up in a "bigger" team. Will you guys be sending Moonglade to Korea?

i really can't believe that you recruited Pinder and Yoonj. Pinder showed results in the BETA. what has he done since? he's so slow and has no mechanics what so ever. you're willing to send a bad player to MLG because you're friends with him. I couldn't see him getting GM on US for months. deth & glade are probably the only good pickups.

gl dox, but in the future make sure you ask someone like mafia or jazbas about who has potential and who is good in Australia. you clearly can't scout players lol

Pinder is one of the top Protoss on SEA and he barely plays this game, he's incredibly intelligent and maintains being one of the best Protoss while putting in very little time. Don't talk about shit you CLEARLY don't understand, makes you come across as an idiot. You obviously don't know who YYJ is either. Are you seriously saying that Rossi isn't a good pickup? LOL - He has improved SO much SO quickly and isn't even close to plateau'ing. You wanna ask someone like Mafia or Jazbas about who has potential? I'd honestly be surprised if they answered anyone BUT Rossi. If Rossi played this game full time he'd be competitive at an international level incredibly so fast it'd make your head spin.

It's not really an accomplishment to say that you're a decent player but you barely play. Everyone would be a lot better if they 'played seriously,' whatever that's supposed to mean.
This is awesome though, I hope this team can compete in the international scene, not enough SEA players are involved in the foreign community consistently... this will be cool

I think what he means is not that they would be better (Obviously anyone gets better after more time) but that Rossi is already very, very good (IE GM SEA/NA, high masters KR, running amok in Aus tourneys) WITHOUT the huge amounts of time put it so it will be interesting to see how good he gets
Well i assume thats what he means

This is cool! I don't like the name choice (like others have said, Nvidia?) but I really hope SEA (or, I guess more specifically, Australian) players can show that we got dem skillz.
Pinder is one of the top Protoss on SEA and he barely plays this game,
This is a weird boast, if he can be a top Protoss and barely play it shows that no one else on SEA is really taking it seriously And I can't tell from the original post, but it doesn't seem that this has changed? Do the players get paid to play the game full-time? SEA's major fault is that it's players can't put in the effort to go full time because it's extremely high risk and low reward, plus you have to catch up to the rest of the world in terms of practice hours put in. If Dox is solving this issue... Things look good. Otherwise, it's really just a swift departure from the MLG Open Bracket.
Wish you guys the best!

Hope you consulted with a solicitor before settling on that name. Just because that word has been around longer doesn't necessarily mean it isn't IP infringement.

Dox is easily one of the most well known 'making things happen/money mover' guy that SEA has. You may remember the Dox Cup #2 which was a fairly entertaining watch but he has done much more. I didn't realise there was such a dramatic increase in funds though.
Apart from sponsored flights to MLG, I'd love to know additional details.

I agree that Pinder is one of the top protoss while barely playing this game. But i would like to see pinder being more active, both in tournaments and in ladder. Before i say that he is deserving of being in a pro team.
I think that him being the best Protoss that is not in a team is true then.

Kick arse news. Congrats to all involved and especially Dox as he seems to be fronting some serious coin. Hope you have a great showing at MLG and pick up some sponsors and invites to team leagues. Does this mean we will see glage in NASL season 3 and maybe some more invidians?

Whilst I was basically as shocked as anyone else to get a chance to be on this team, it's also the reason I decided to return to playing and putting time in to being the best player I can be for the first time in a long time. I 100% agree with the criticism that I haven't been active in however long in sc2 and that still getting results without practicing isn't something to boast at all, but to be frank I've been given opportunities by this team I thought I would never have being from Australia. I look forward to silencing anyone who thinks I plan on just lounging around and being happy and coasting to top 8 in Aussie events like i have been the last year .

Pinder beat IdrA. :D
What Protoss hasn't beat Idra though?

Moonglade always seems like a chill and respectable guy. Wish him, and the team, the best~!

What, sickest line-up! Looking forward to seeing them play in the GSTL, one the most talent-filled team in the world right now. Good luck to all of you!

Absolutely awesome. Pretty good lineup that i can't wait to see play. I assume most if not the whole team will be down at the ACL in Sydney so not to long to wait. MLG will be really interesting and a great goal for the players as well. Would love to see a deep bracket run and some pool play. Going to be brilliant

Because it can be difficult to compete in highly visible events without sponsorship, there aren't that many open events with high visibility, or with SEA qualifiers. The last international tournament with SEA qualifiers was IEM Kiev, and he dropped early in that. He won an Australian LAN in January, and the first round of qualifiers for another in the same series last week or so, so he certainly hasn't been inactive in terms of Starcraft. He's also still alive in NASL but season 3 has yet to start up, so that might be another reason why he hasn't been on the radar.

Don't you guys think there's going to be serious branding issues here with Nvidia? I know you are just starting out, but its a really serious issue you should handle right now. Apple tried to sue Wapple based on confusion of branding etc. When you approach sponsors and people who dont know you're team, you are going to have this conversation over and over and over again, create confusion for fans, create confusion with brand partners, press, everyone. Just fix it now before you get going.

Have to agree with Kennigit completely on this issue. While it, in all technicality, is not a trademark infringement everyone is going to believe you're in some way affiliated with Nvidia. If you choose to stay with it just know that if you don't end up with sponsorship from Nvidia themselves you're going to find it difficult to gain sponsorships from their competitors due to the confusion it would create.

I know you're being constructive and i respect that, but I completely disagree.
If Dox was going into production of Graphic Cards, then yes, i'd call that copyright infringement, or if he decided to use the Nvidia logo or tried to associate the team with Nvidia then i would call that infringment.
The name is also used for other various companies too. I'm sure Graphics Card Nvidia never tried to sue Exhaust company Invidia or visa-versa.
I don't think any serious issues would arise from the naming of team.

I honestly haven't come across that yet, and more often than not, the team is being externally branded/described as Envy (Nv), rather than Invidia, which was my intent.

I agree with Kennigit though, change your name now before you get started. It's only going to be trouble.

Yeah you guys totally ripped off that company ... T_T
There is no way any copyright has been infringed. Just confusion with people who think Nvidia (the graphics card company) picked up some players and added an I to the name.
|
If anything, Nvidia gets a bit of free advertising out of this
|
Totally agree with Kennigit.
I'm seriously surprised about you guys who are acting like you're lawyers and saying it's not trademark infringement. If any of you actually are, perhaps it would be a good idea to state that, so we can take your opinion a bit more seriously?
IMO it is far from clear cut that there's no infringement. I'm no IP lawyer either, but it's better to be safe than sorry right? Allow me to link some things that might be of some interest:
A chapter out of a book by one of Australia's best IP lawyers, SC Shane Simpson: http://www.simpsons.com.au/wp-content/uploads/music_business_3_chapter_011.pdf
Before you say, "wait that book is about the music industry", just read the first 3 pages, and ignore anything that specifically relates to music. It applies to any branding, so just extract the key statements from it.
Here are some particularly interesting parts:
"Don’t assume that you don’t have a problem just because the other user of the name is in a different business or in another geographical area. They may well have the right to stop you from using the name."
"If your searches reveal that someone else is using a name identical or even similar to the one you want to use, be careful! Don’t assume that ‘things will be all right’."
"In the general law, there is an action called ‘passing off ’, which prohibits any party from misrepresenting itself (or its goods or services) as though it was another. In other words, it prohibits the false appropriation of the other’s reputation."
Trade Practices Act s53 regarding false representations: http://www.austlii.edu.au/au/legis/cth/num_act/tpa1974149/s53.html
|
I'm not a lawyer, but I'm pretty sure I've read about cases where the fact that consumers were confused by the name was used as an argument that there is an infringement.
This thread (and the sc2sea one) shows pretty clearly that both Invidea and Nvidea's target audience do confuse the two.

Those of you asking where moonglade has been, he recently won ACL Gold Coast, and will hopefully be at ACL Sydney on April 21-22. ACL site: www.aclpro.com.au

Is this affiliated with nvidia / is it their team? That seems kind of huge if they are sponsoring a team now
|
wow, good to finally see a pro Australian team. Hope you all do well at MLG!

That's silly. You're a team of people who play computer games. Your name is phonetically identical to the name of a company that is heavily invested in the computer games industry. Most of your viewers will come in contact with your team through computer game related media, and will make the connection straight away. Any number of posts in this thread prove that.
You're not going to make that go away by pointing at the auto company and smirking. That's completely irrelevant. It's not even about copyright, it's about the immediate reactions of the people who see your clan name, and the fact that there's no way in the world another gaming company will sponsor you when you're representing Nvidia for free and without their permission at the same time.
Just save yourselves the pain and change it. You're adamant that most people call you "Envy" anyway, so why not make that official?
|

Pretty much agree with this.. Its all good and well to point fingers at other companys/organizations with similar/the same name, but nvidia is directly related to the industry you are in..
Its the equivilant of a racing team calling themselves 'Team Firrari' without ferrari's permission and not using ferrari cars, saying its unrelated or doesn't make a difference..

Why are you quoting the Trade Practices Act?.. LOL - Misrepresentation is about, saying a product will do X but it doesn't. Not, making a product look like another to trick you into associating the other brands reputation with the new product. Anyway, that is quite common in business. Look at how copycat brands align themselves with the industry leader next time your at the supermarket.
For the record - I Study Marketing and Business Law (about 6 weeks from Graduation).
There is ZERO copyright infringement involved in the team name. While it can be presumed that ATi aren't going to sponsor this team any time soon - the word being used here is Invidia - Latin for Envy... and the team abbreviation is Nv... not Nvidia - additionally the teams colours (Red and Gold) are not similar to Nvidia (Black and Green) so there is zero visual similarities.
The fact that you guys are all thinking of Nvidia proves how successful their marketing brainwash has been
Perhaps you're all just envious of the awesome team Dox has put together?!

out of interest, Dox stated that Nvidia had no beef with the name which would suggest he/nv have been in contact with them... was there any mention of potential sponsorship in that discussion? Curious about the overall sponsor situation as well as getting to big tournaments from Australia is pretty expensive, I'd hate to see another ROOT situation happen.

How does this stop any confusion with the NVIDIA brand?
If you're 'Envy', call yourself eNVy ...
If your Invidia, well, call yourself Invidia, but dont expect people not to be confused with the already established brand Nvidia (one of the biggest chip manufacturers in the world with multi million $ marketing wheels whose purpose in life is to make their brand recognised above all others .... even small starcraft 2 teams ...)

Grats on your sponsorship! It's great to see more companies supporting ESPORTS.

That's a really weird name choice. Pretty sure lots of people will wrongly assume nvidia is sponsoring you guys

ooh, nice, hopefully this can make the SEA community more visible on the international stage! Do you have anything specific planned regarding what you will do as a team?
Edit: my brain is retarded and didn't realise my question was already answered in the OP. Also I am 1 month behind in the news

Great news
Best of luck practicing with your new teammates nv!
p.s. my vote for the team name would be "Team I Have Many Leather Bound Books" (Example: IHMTLBB_MOonglaves)

glhfgg mOOnGLaDe, all the best with the new team!

There is ZERO copyright infringement involved in the team name.
Lol. You think doing a business degree which includes a couple of business law subjects qualifies you to make calls about what is or isn't IP infringement? Especially when your degree is from a below average uni like SCU?
Well, you're right about one thing. There is no copyright infringement involved in the team name. Because copyright has nothing to do with protecting organisations' names.

Uhh thanks for the month and a half late bump with a useless comment....

Regardless of copyright or whatever, why confuse people?
It's a bad name just admit it, why would you choose a word that could be confused with a potential future Starcraft sponsor?
Why did nobody part of the organization bring this up?
/facepalm
