I don't think it's unfair to take it into account but it cannot be the only thing you look at. I've been wrong on day 1 before. I do however probably have an unusually high chance of hitting scum on day 1, so it certainly should raise some alarms. My day 1 play is just about the only thing I do very well in mafia, and basically the reason I am considered a good player.
What you really have to look at is how I carry myself to the conclusions I reach.

What's wrong with my case on CC? He hasn't posted at all this game, and his posts show that he has no interest in playing. This is contrary to his entire town play. Everytime he rolls town he is very active poster (23 pages for an entire game, 7 pages in the first 72 hours of the game) and he clearly has a dedicated interest in figuring out the mafia. Furthermore he always excited to be town, and clearly wants the mafia dead and does analysis. There's none of that this game.
I'm flying to Vegas today for CES this week, so my time is going to be more limited the next few days.
