If the hearing is soon, I would send a motion requesting a continuance to the court advising you have a conflict and cannot attend. Request another date that you can attend and then make sure you can show up. Courts don't normally default people, especially if the other party set the hearing date. From my understanding, which is limited, most custody battles end poorly because the defending party can't attend and the moving(in this case, the Ex) party gets to lay down the fact set uncontested. And for the love of god, lawyer the fuck up and never, ever get emotional in the court. | ||

Mostly because I know she has purposely had limited involvement in our kids lives and not asked any questions about their schooling or home life or anything simply so she could request a hearing to call me a douchebag who is screwing her out of a relationship with her children. I wanted to call her a stupid conniving bitch, but that would not have worked out well. It will be even worse in court when I see her dick hungry face in person. And thanks for the advice. Just call it a conflict and don't reference about work. The court doesn't give a shit why you can't be there, just that you can't attend. Just call the clerk's office and be super nice(I mean super nice, like act like your sorry for even bothering them, never be mean to a clerk, I don't care how bitchy they are) and ask how to file a request to continue the hearing. You will likely have to send it in by mail, but the court might be able to point you to an online form you can print out or something. Edit: Just re-read that. Don't send all reply emails ever. Don't put shit in writing. Its a fucking trap. Emails can be printed out and then submitted to the court as evidence. They are magic like that. | ||
