That is true, and you are right, no penalty was the better choice but are there not refs to check per VAR to see if this is a penalty?

The referee may decide to ignore the VAR recommendation, penalty/no penalty is actually a check they commit. So VAR team may have mentioned that and the referee may have decided to ignore it. If it would be a clear red card with penalty VAR would have overruled the decision to let it be or recommended the on field review(if EURO has this option enabled)
EDIt> IIRC there are 4 categories in which VAR comes to use - goal decision, penalty decision, red card decision and when the ref mistakes players.

VAR is only supposed to intervene in clear and obvious mistakes - not in a 60/40 call where the ref went with the 40 option.

Hey, the guy was the only one of my strikers to actually score! Kane and Depay failed.
And Austria opened vs frickin North Macedonia and to me he was the only guy actually capable of scoring in that team.... So this felt smart. Didn't consider him being such a retard...
