The shape of the assimilator is a square, and the probe is blocking a cube of it. However, if you have your probe out of vision of the geyser, and you build the assimilator without seeing the probe that is blocking the geyser, than you will be able to build the assimilator and the blocking probe will be displaced. So actually, all HerO had to do was move his probe out of vision for just a second, and then he could've build the assimilator easily.
