Sure, as long as its not obvious what someone's alignment is based on how they use it. In that example is a bit borderline, as the role creator could tell that the person was town if they used their shot during the day. The role would probably have to be tweaked a bit, maybe allowing the mafia to shoot either during the day or at night, but only allowing the townie to shoot during the day.
