That doesn't prove anything. No one PROVED that Hesmyrr was killed by Gunpowder. That was just the most likely explanation at the time.
In a normal mafia game, bussing a fellow mafia brother is a popular way to establish trust with the town. In this game, an analogous method would be to "Attack" them at night.

This has already been answered.
Your conclusion that you are Town relies on the premise that he had no way of saving himself.
Town has no idea the extent of the super-secret mafia powers. It is certainly possible that Mafia had a way of providing one of the territories back to Hesmyrr.
Since your premise cannot be proven, your conclusion is faulty.
