Does anyone know where I can find a calm, rational, and well sourced article about this? I'm completely willing to believe that it's 100% terrible and only the result of evil corporations trying to control us and our government, but I'd like to hear it from a more thorough source.

One of the other dangers of this bill is it introduces penalties to parties that are innocent by today's laws, laws which are untouched by this bill. It simply adds new enforcement options that affect people who aren't breaking the law.

Possibly the single dumbest thing this bill does is remove the safe harbor provisions of the DMCA. The DMCA was poorly thought out as is because it just doesn't work on the scale of the internet (hence why you can get literally anything pulled off Youtube without review just by flagging it for copyright violations without being the copyright owner.) But at least the DMCA only caused the unfair removal of individual works. Blocking a site's revenue and removing it from DNS because of third-party content is ludicrous when there are often millions or even billions of works hosted on a site.

It is literally impossible to prevent third-party copyright violations without using a whitelist model. It's just a matter of sheer scale. That alone would effectively end the era of user-generated content on the internet, and probably cause billions in economic damage as a result. Heck, considering the history of Google, Facebook, Zynga, and others, it could very well be trillions in lost opportunities.

Then there's the fact that accusations don't even need review to result in total site shutdown. The DMCA was already bad about this, since little sites could be targeted by random individuals or companies and forced to pull content simply because they couldn't afford to go to court. But at least the DMCA just resulted in the removal of that work and allowed time for a response. With this bill, it's five days (which is absolutely absurd by any stretch and cannot even be argued as ignorant; it's downright malicious and unconstitutional) before you lose all sources of income and funding for your site. Which may be your business. Without review. And there's nothing stopping someone from filing against you just because they feel like it if they can claim they had reason to believe you might be violating copyright somewhere.

It's said that you should never attribute to malice what can be adequately explained by ignorance. But there is no possible way that these points have not been raised. This is a purely malicious buyout of our rights and tech economy by old rich men.

I found the techdirt articles really helpful, especially this one, which is linked in the first article your posted. It contains a copy of a letter from a group of law professors about this.

It looks like this has all the problems of the DMCA with even fewer protections, a wider reach (implicating companies and removing most if not all safe harbor protections), more severe penalties, and a weaker appeal process. It sounds like a nightmare to me.

And honestly, the guy in the Forbes article didn't even sound that wrong. This just isn't the right approach. It's mostly the prior restraint issues, striking lack of due process, and general heavy-handedness of the whole thing that bother me.
