But if Jon Snow still belongs to the night's watch, he shouldn't be allowed to recapture winterfell.
No. Long story short, no. Thats the whole point of him dieing and coming back. He no longer is binded by his vows. He probably will stay in the north, knowing the battle for the dawn is near. But no, his watch has ended.

It's not like the vow is any magical binding or anything, and kings landing has changed hands like 5 times since he gave his vows, so legally nobody gives a shit either. Technically the only thing keeping him following it is his own sense of honour, and if the majority of the nights watch are trying to kill him I'd imagine his will to survive, especially considering how much higher the stakes are after the fight north of the wall, would outpace his "loyalty" towards whatever's left of the watch.
He knows all about the walkers at this point, this is way bigger for him than just the knights watch vow. It's now about keeping all of westeros defrosted. If anything, he probably see's the rest of the watch as in violation of their oaths at this point.

Laws and vows can be broken. Jon was about to break them when he rode out for Robb after Ned's death. Then again with Ygritte when he joined the free folk.
If nobody can enforce the death penalty (who, the Night Watch mutineers or Boltons? These traitorous assholes are about to get dunked), then fuckall. As people already mentioned, I doubt anybody gives a shit at this point when there are more pressing matters at hand.

Ooh I like this theory. It would mean Arya finally cast away her identity and became no one. A great counterpoint to her scene with Jon in season 1.

Don't forget that Arya hid his sword needle, and didn't throw it away. I'll assume that there was a reason for it. Itcould be key to regaining some of her personality back after becoming no one.
