That's how lawsuits work when both sides did stupid things. Its just that McDonalds was more stupid due to the numerous complaints and full knowledge that they were serving 200 degree coffee.

If the Defendant is over 50%, they have to pay damages. This might be a stupid question, but are you a lawyer/judge? You seem to know a lot about the courtroom.

I manage like 5 attorney's case loads. I would pay money to talk to the Judge who posts on Dota forums. Hell any gaming forum really.

it's just this thing should have never happened, and the new warnings don't really change shit. the only decent thing to come out of all this is that all companies serving coffee should hand it to their customers at 160 or something. kinda reminds me of people that eat fish fillets at restaurant and blame the establishment for swallowing a bone 'my fish steak should not have had bones in it!'

The jury raked them over the coals and awarded the Plaintiff for 2.7 million, which was like 2 days of coffee sales for McDonalds. That was also a law suit in MA and was ruled to be acceptable because it was not foreign to the chowder. http://www.fastcase.com/wp-content/uploads/2010/07/Webster-v.-Blue-Ship-Tea-Room-Inc.-347-Mass.-421-198-N.E.2d-309-Mass.-1964.pdf Its one of the most famous cases in law because the Judge of the Supreme Court of MA including his family recipe for fish chowder and explained that removing the bones would ruin the meal.

Some cities have parades. It's a little awful tomorrow where I live to have a bbq, and most big retailers are closed tomorrow IIRC.
