What happens when an adult female uploads pictures of her younger self? Will she be prosecuted for CP?

There seem to be lots of nudist sites that display naked children. So that alone cannot be CP. I think it depends if the photos somehow emphasize genitals or not, but not sure at all. But why risk anything in that regard?

If the distribution is illegal (which i think it is), it should not matter if you are the same person as in the photo, because no matter what you are still distributing a pornographic picture of a minor.
And if it is really pornographic material, my guess is that the person who actually took that photo would also be prosecuted, after the confusion has settled down. Because for this situation to exist, someone had to take a pornographic image of a minor, when she was still a minor. Which is definitively illegal and the fact that that act was a few years ago wouldn't change that in the slightest.

Unfortunately that's a really stupid grey area (at least in Germany). Since you can't give consent to CP, even pictures of yourself as a minor are technically illegal. And since owning CP is already a felony you are actually committing a criminal offense if you own naked picture of yourself in Germany as a say 16yo (same for owning pictures of your 16yo girlfriend).
Of course, such a case has never been prosecuted and I would very much hope should that ever happen the judge will clarify that the law should not be interpreted in a way that you can be victim and offender at the same time.
At least it is recognized and there are discussions about fixing the law here to not criminalize every consensually sexting teenager, but so far technically even just owning the "CP" material of yourself is illegal.

Yeah, but who wants to be the politician who gets out in front of that issue:
"Hey guys, you know what society needs? Looser laws on child porn."

Actually I don't think it's nearly as difficult as you think it is. It's something that'd be done in the background, and when it shows up, you bring up a valid and convincing argument. For example, if you say what people here said, that you can't own past underage pictures of yourself, then society as a whole would be like... Okay, well that's silly, this law needs to be changed.
My problem more so, is just how bad child being naked is for society, I think it's almost completely irrational. I'm not even talking child porn, like yeah, a 30 year old black 9" penis inside a preteen girls butt, we can mostly all see a problem with that, and we understand that promoting this behavior, will lead to young children being taken advantage of to create this content (as people are willing to pay for it).
To me it just seems like the punishment is far too large regardless, for someone who is "potentially attributing to the problem of child exploitation". That's like someone getting 25 years in jail for not warning the police of knowing about someone who was potentially going to commit murder. I'm not justifying the behavior, but I don't think the punishment is fair.
In my opinion, it all comes down to the laws (at least in Canada), where the government treats you like you know nothing and you have practically no rights to do anything before you're 18 for most things, and 16 for a few others. I think a legal and regulated market could be created for teenage porn, or just something that gives more freedom to people and families about what they'd want to do with their underage content. It's absurd to me that I could get in trouble for distributing my baby pictures or something. Willing teenagers that do have intercourse, watch porn, sext, etc. clearly don't care nearly as much as policy makers about others seeing their naked bodies, and while there is room for abuse, there is room for abuse in anything.
Child nudity laws need to be looked at again, and some more research looked at as well, since the way we look at it now often arises from irrational fears that may have no basis.
Looking back, yeah, I made some stupid decisions when I was a teenager, but at the same time, I had a brain, I had a sense of right and wrong... But we were treated like little children in high school. I'm honestly still baffled to this day how large the jump between university and high school was in terms of priorities. High school was kindergarten padded with pillows, while university was a viking tribe. As a society we should focus more on educating children (after-all, research suggests that junior high school is where people make it or break it), instead of giving children all the reason to fuck up in the world due to there being no consequences to anything, as you're not given any rights in the first place.

The overwhelming majority of child pornography does not come from consenting teenagers; it comes from adults abusing minors as they exploit them in a variety of horrifying ways. Furthermore, your general disapproval of the high school-university jump as a social phenomena is not a very good basis with which to defend the merits of legalizing child pornography. In fact, it has practically nothing to do with the government's interest in making sure that there is a strong deterrent to those who would manufacture or distribute child pornography. Read the basics in the wiki and realize that you are defending a practically non-existent group of people.

An extensive collection indicates a strong sexual preference for children, and if a collector of child pornography is also a pedophile, the owned collection is the single best indicator of what he or she wants to do.[62]
That was from the wiki article you linked me. I dunno, I might watch some out of the ordinary stuff, but that doesn't mean it's what I want to do. Just because some women get turned on when being degraded in bed, doesn't mean they wish to be degraded in the real world. Just because someone has x fantasy doesn't mean they try and project it on society.
I objectively don't understand why people think that someone who watched child pornography deserves a lifetime sentence, something that wasn't even a crime 40 years ago. I'm not defending them, but I have empathy for people with different sexual desires, who all likely suffer from a similar "condition", if that's what you'd call it, and we don't dehumanize any group as much as the pedophiles.
|
People have very different opinions about what crime deserves what punishment. In the end somebody had to make a call and just write something down. If it was a bad call it will be changed, but you also have to consider the public image of child abuse. In German media they are pretty much the worst of the worst, so nobody wants to associate themselves with that image. In fact, the largely unpopular super-right-wing party NPD tried to get voters by advertising with a death penalty for child abusers. Trying to change public opinion there is a tall order and any politician who tried would be out of a job.
Also important to consider is what it means when there is suddenly more demand for it, because right now anyone who knows the first thing about internet crimes won't even try to access it. Obviously it would lead to more production of the content and make it increasingly difficult to protect the underage people involved. I know how easy it is to manipulate teenage girls (I assume you considered only teenagers for this) to do anything, so I think it's only well and good that they can't participate in porn. 99% of teenagers just can't protect themselves against exploitation, trying to find a law that would give freedoms to the 1% and still protect the remaing 99% seems impossible to me.

That talking about Putin leads to child pornography makes total sense to me.

Is it theoretically possible to achieve complete simulation of molecule interactions? Let's say you have protein molecules mixed with water molecules. Is it theoretically possible to determine all necessary parameters including structure, position and momentum of the molecules in an experiment? And then use this information to create a computer simulation that is a one on one copy of the real thing?
How many and which of the necessary parameters can we exclude to still get meaningful simulations?
