The future of ProGaming is jeopardized by some unfortunate series of events. The two sides, OGN & MBC and IEG & KeSPA have met to negotiate on March 16th. The following articles were all taken from Fighter Forum.

On the 16th at approx. 7PM, OGN has stated, "the negotiation is over. IEG’s terms cannot be accepted by the broadcasting companies so the negotiation for ProLeague’s broadcasting rights came to an end.”

OGN stated that IEG demanded
▶For the 3 years worth of broadcasting fees, both companies pay 7,5000,0000 Won (approx. 3/4 million dollars U.S.) – adding up to $1.5 million
▶Both companies pay 40% of sales (sales, not profit)generated through ProLeague VODs to IEG
▶Both companies provide their own developed contents (commentators, etc.) for free (not sure about this translation)

OGN stated “both companies have already acquiesced in many aspects during the ProLeague negotiations. Currently we have conceded the broadcasting fees and 40% of the production. Also OGN has clearly stated that “Paying 40% of income in VOD sales will truthfully make the company suffer net loss” so this is an impossible proposal.

OnMedia PR Team’s Lee Young-Gyoon leader said “No sports in the entire world have ever provided the contents developed by the broadcasting company for free. Completely ignoring the costs and creativity cannot happen.”

OGN stated “OGN and MBC Game has conceded too many things in order to prevent ruin no matter what. In a situation where there is neither justice nor benefit, we have made strenuous efforts to prevent the e-sports industry, which we had cultivated so far, from collapsing. There was no way to accept a proposition that completely ignored a company’s intrinsic reasons for existing.”

MBC Game has stated their stance on the sudden end of the negotiation over broadcasting rights. The following is MBC Game’s full official statement.

MBC Game has continued the negotiation over ProLeague broadcasting rights, but due to KeSPA and IEG’s abnormal broadcasting fee demands, there was no way to accept the demands – and the negotiation over ProLeague broadcasting rights came to an end. Currently, a part of the game team has stated that they will not be attending MSL Preliminaries and pulled out. MBC Game will try its best in investing for e-Sport’s improvement but will not continue negotiations solely for profit. We, MBC Game, will put more efforts into the growth of e-Sports for the future.

-The negotiation came to an end
▶We negotiated with IEG today (16th) at 12, with our final revised proposition. The proposition was the product of us conceding as much as possible. We took into account for e-Sports’ market growth that was announced by Samsung Economics Research Center, the amount of profit we can gain from selling the contents without IEG, and proposed the most reasonable amount. However, IEG is trying to make too much profit from selling the broadcasting rights.

-What are your standards for “too much profit”
▶IEG has yet to contribute to e-Sports. Their only reason being having bought the broadcasting rights – IEG trying to make more profit than the broadcasting fees is hard to accept. It is clear that once you add up the amount they are demanding from both companies and the contents, it exceeds the amount that IEG paid to KeSPA. To trying to make profit without making any contributions is absurd.

-Due to the negotiation’s abrupt halt, the MSL preliminary was stopped.
▶It is startling. We did not expect this situation. After expressing their intention to boycott then deciding to attend, it is not as if we agreed to decide on attending depending on the outcome of the negotiation. This type of reaction is truthfully perplexing.

-What are the chances of resuming the negotiation
▶In attending today’s negotiation, we were told by IEG that it was the last negotiation. IEG expressed that they will not back up from their final proposition. We agreed that it was the final negotiation, and we believe that there will be no further negotiations.

-What are your future plans
▶We have judged that today’s negotiation is final. We are considering to exclude ProLeague and producing self contents.

KeSPA has stated that the ProLeague broadcasting rights negotiation has officially come to an end.

According to the association, on the 16th, ProLeague’s official organizer, KeSPA, and the company holding the broadcasting rights, IEG, has requested and held a negotiation with OGN and MBC Game, the primary negotiators, but due to the uniform refusal to negotiate, the negotiation could not be continued.

The association stated that “the 3rd negotiation progressed after a delay, taking into account for their contributions to the growth of e-Sports. The association promised the following if OGN and MBC Game participated as the broadcasting company:
▶In accordance with the past year 2006’s cost, a promise of 10,0000,0000 won (approx. $1 million) per year as a development support
▶As the main broadcasting companies, the guarantee of a stable position for both companies
▶In running ProLeague, both companies will be in the negotiation
▶Both companies’ match supervision: 100% for 2007, 60% for 2008, 2009 guaranteed
▶Organization 100% guaranteed
▶Acknowledgement of the copyright for NewMedia

The sponsor has agreed with the two broadcasting companies on the part regarding creation of the broadcasting material and the copy rights, but expressed different stances regarding the broadcasting fees. The sponsor’s proposed 7,5000,0000 Won (approx. $3/4 million US) over 3 years was lowered by OGN and MBC Game to 3,9000,0000 Won (approx. $390,000 US) over 3 years by pointing out the TV production material’s request of purchase. (I am SO confused – someone else translate this part..)

In response, IEG’s position was that it is hard to allow for TV production material’s additional purchase as much as it’s hard to provide monetary development support. In addition, the proposed amount for TV production material’s sales cost is hard to accept so there was a clash in the two sides and the negotiation came to an end.

Due to the abrupt ending of the negotiation, the sponsor is planning on completing the contracts with a 3rd cable TV company, which had been a back-up solution, as well as finalizing with the post-ProLeague’s sponsor, so that the upcoming opening of ProLeague on April 7th can proceed without problems.

Regarding this, the association’s Jae Hoon-Ho director stated “after attempting many times to talk it out with the two broadcasting companies, which have contributed so much to e-Sports to this day, it is regretful that the negotiation could not be complete. But the ProLeague, which has taken its place as the biggest, greatest e-Sports contents, is being prepared to continue as planned -- with 12 professional game teams – so it can proceed normally.

On the 16th, after KeSPA, IEG, OGN, and MBC Game’s negotiation came to an end, KeSPA’s Jae Hoon-Ho director had an official interview in the conference room. Jae Hoon-Ho director said “the finalizing negotiation will continue until the weekend, and it cannot be revealed but the association has a big card to play”. The following is the interview.

-What was the result of today’s negotiation
▶Today’s negotiation came to an end

-What happens after
▶The premise that KeSPA must continue ProLeague with the two broadcasting companies does not change. Please wait until everything is finalized. There are plans to negotiate once again with OGN and MBC Game by this weekend.

-They say that the difference between the conditions proposed by KeSPA and IEG compared to the conditions proposed by OGN and MBC Game is big.
▶It would be nice to have an agreement between both sides’ proposed conditions. The difference is great but I believe that this can be fine-tuned over the weekend.

-What’s the reaction of the directors
▶The view that the two broadcasting companies, game teams, and the association, who have all lead e-Sports together, must stay together hasn’t changed.

-After hearing that the negotiation came to an end, the MSL preliminary was boycotted. If the negotiation progresses successfully, are you thinking of restarting it
▶Once the negotiation over ProLeague broadcasting rights is complete, the preliminary will continue normally

-What are your thoughts about the broadcasting companies expressing their opinions through TV
▶It is regrettable, but in a viewpoint of improving e-Sports, I hope they include the association and game teams’ opinions.

-How will tomorrow’s Maters proceed
▶Without any complications. The tournament was already in progress so it will continue without being associated with broadcasting rights. I think such respect is in order for ShinHan Bank which has invested into e-Sports.

-It is said that the fans will protest in retaliation tomorrow
▶The association still maintains its position to resolve this problem through conversation. The fans are e-Sports’ biggest customer. We are trying to resolve the problem with the broadcasting companies through conversation. It would be nice if the fans could understand this part.

▶The association is trying to solve this problem in a constructive way. We will take into account for the broadcasting companies’ position, IEG’s position, the association’s position and will lead through conversation.

-Do you have a big(trump) card for the negotiation
▶It is hard to reveal, but we do

-The negotiation came to an end
▶We accepted every single demand from both companies. We accepted the copyrights for the two companies’ contents that included commentary and subtitles (the currently broadcasted ProLeague contents). And also we accepted the 송출 (no idea – maybe selling?) to DMB as it was done in the past, and in the case of internet VOD, there was a conflict, but we accepted it in the end. For internet VOD, if it is provided the same, both broadcasting companies cannot sell it to Portal so there was a problem, but we agreed to accept it in the end.

-There is a big difference in the broadcasting fees for the two sides
▶The offer was $3/4 million over 3 years from both companies as well as $1/2 million a year to the two companies. If you look at it, if both companies pay $3/4 million in broadcasting fees, over 3 years, the total fee comes to $1.5 million. On the other hand, IEG was planning on providing $500,000 per year, so $1.5 million over three years. It’s basically the same amount. $3/4 million is not a ludicrous demand. In addition, the two broadcasting companies have additional profit from advertising or internet DMB. However, they proposed $390,000. The part I don’t understand is during the negotiation, they revealed the contents of the negotiation and sent an official statement to their respective offices. I view that they had no intention of negotiating.

-What happens to the ProLeague schedule
▶It is to be decided tonight (16th) in the association’s director’s administrative conference.

I did this very very quickly so there may be some translating errors.
This is officially the most translating I've ever done in my life in 1 day -- 12 pages in MSWord!

To express some of my personal opinions, I feel extremely saddened by this situation. Regardless of whether or not they had the right to do what they did, all sides are blatantly showing that they're profit-driven and OGN & MBC Game have showed that they're willing to play dirty. I sincerely hope that this problem is resolved soon without too many casualties.

Fuck. IEG is so fucking gay. They're completely destroying progaming. If OGN and MBC aren't going to pay up because it's a shitty deal, it's not like anyone else is. Then what? Everyone gets fucked over, the players and the fans, and the sponsors.

This looks like a case of disgustingly bad understanding of copyright/property/labor laws on everyone's part. Someone get a lawyer pleeeeeeease and then settle this.

Thanks for translating, infinity. Really, the best possible outcome that can come from this now is KeSPA refunding in FULL all of what IEG paid for those rights, and then instead of auctioning off the rights, selling them non-exclusively to several broadcasting companies. They should have done something like this from the beginning. I imagine they wanted to, but OGN and MBC wouldn't have it. But if KeSPA did it again, then OGN and MBC would have to agree with it.

Are the pro-teams contractually bound to KeSPA/IEG in anyway? If this stalemate goes on for a long time and the players are doing nothing would it be possible for the sponsors to tell KeSPA/IEG to go fuck themselves? What IEG is doing now is not in the best interests of any of the sponsors because it means their players are not going to be able to do what they're payed to do: play Starcraft.

Trying to make sense of everything, rambling imminent.

Hm.. so:

KeSPA runs the Proleague (provides locations and hardware, as well as league administration).
IEG pays KeSPA for broadcasting rights.
MBC/OGN pay IEG for (non-exclusive) broadcasting rights.

MBC/OGN make money from advertisers.
MBC/OGN provide (pay) commentators, cameras.

I'm not clear on the VOD situation. The IEG guy talked about making VODs available internationally. Looks like:

IEG owns broadcasting rights, so they own the VOD content apart from commentary.
MBC/OGN make money from selling Proleague VODs.
MBC/OGN pay 40% of sales from VODs to IEG.

I'm guessing MBC/OGN are in charge of distributing the VODs (providing bandwidth, pay system, whatever). But that's probably just in Korea, I don't think they'll be distributing them abroad in the way the IEG guy mentioned.

It does seem like MBC/OGN might be getting screwed here, since they provide the commentators. The question is, will any other proleague broadcaster use their own commentators, or would they get to use MBCs or OGNs without paying MBC/OGN. The latter would be screwing MBC/OGN over, but I don't think that would happen.

For VODs, well, IEG owns the broadcasting rights, so they provide the game. MBC and OGN provide the commentators. Both deserve a cut of VOD sales. The amount depends on what those are worth, and who provides the VOD distribution.

Sorry, my post's pretty disorganized; I was figuring stuff out as I was typing it

If the kespa cup broadcasting was any indicator, not having the commentators of MBC/OGN will make the product worse by a very very large amount.

LMFAO yea, I really hated the Kespa Cup broadcasting. It was terrible. That guy who started sentences slowly BUT INCREASED HIS VOICE AND SPEED LIKE A JACKASS, REPEATING PHRASES OVER AND OVER AGAIN REALLY QUICKLY LIKE A JACKASS, really pissed me off. I could just hear his asinine jet engine of a voice whirring up every hint of action.. Also everything was so ghetto -_- compared to OGN/MBC...

Hm.. advertising must not pay much if $250k per year is too much. Any idea what exactly they mean by the "40% of the production" that they already conceded to pay?

It's pretty obvious that advertising on MBC and OGN costs next to nothing when we see the Pounce Pounce Meow ad 7 times in one commercial break (OSL finals).

Well, what you say is right, but the "KeSPA" or "the Teams" were really stupid selling the full rights to IEG without thinking something like this could've happened. I really hope this gets to good terms I would hate to see the Korean Scene dying for some stupid movement by teams/Kespa/sponsors.

MBC and OGN are both part of KeSPA too right? They both have their own teams and they didn't pull their players out of the MSL qualifiers. This seems to suggest that the other teams could let their players play in OSL/MSL if they wanted.

MBC and OGN are part of kespa, only by virtue of their sponsorship/ownerhsip of their respective teams, as you say.

The governing body of Kespa is a board, and 2 teams obviously isnt the majority... well i dont know what goes on within the boardroom, but i'm sure there was disagreement b/w ogn+mbc vs the rest of the sponsors on this regard.

Hmm yea muramasa, kinda confusing what's going on here. I'd say that
1) board comes to conclusion that they will boycott their players if contract doesnt happen.
2) OGN MBC teams dont agree with this.
3) boycott happens, but OGN/MBC ignore the boycott.

smth like that.

I wonder who this mysterious 3rd cable channel that's mentioned is. If OGN and MBC are both convinced that under IEG's terms it will be impossible to turn a profit, I'm surprised that someone else would try.

If it's a backup solution, the "third" cable company who has showed Starcraft Showmatches, is CJ, and they are probably that third. I still don't get it, I know KeSPA are "most" of the teams, but they should have thought of this, before going money-whore like and sell the rights to some no-name company, and not have thought about this happening.

Am I the only one who wants to grab the owner of IEG and give him a lesson of Starcraft History?

Even thought they are the "International e-Sport Group" they are acting like, the "International Money-Whore Group". I cannot believe how grey is our future as gamers, and watchers .

They bought the broadcasting rights from KeSPA because OGN and MBC Game didn't bid on it.

Infinity21, this is amazing. You did such a good job. I know how long that must have taken.... you truly deserve plenty of praise for this.

KeSPA's interview brings me some hope. I was generally expecting the worst... after all of this news this morning I had formulated a worst case scenario that goes something along the lines of Proteams boycotting MSL/OSL, while fans boycotting Proleague.... which would have brought the end of Progaming in general.

But since KeSPA's still tryin to contact them I'm hoping we'll still see some good news.

▶We have judged that today’s negotiation is final. We are considering to exclude ProLeague and producing self contents.

I wonder what is possible through "self contents" with most of the teams' players boycotting (although they have MBC/OGN team, plus (lol) whatever players they want to pick up from pantech P)

Maybe they'll try to be creative somehow, instead of the standard league formats they've been using for years now. (mbc seesm to be going in this direction, with school league, rookie league, and mbc players doing custom stuff for them like commentary or race matches_

Another news: http://www.fighterforum.com/news/news_read.asp?cat=ISS&idx=17159

This is the opinion of the 8 teams that are angry with the situation. (all teams except MBC, OGN, and eStro) My Korean isn't good enough to do such a nice translation as Infinity21, but it's basically saying they believe OGN/MBC should try to be more understanding and think of the progamers during their actions.

They believe showing the teams leaving the stadium on live tv, making announcements with biased opinions, and making polls on their website to get the fans on their site is unprofessional and unfair (or something like that).

I'm sure Infinity21 or someone else will explain much better.

It's unfortunate for MBC & OGN since they are the original founders, but ..

.. MBC & OGN is at the mercy of KeSPA.

Even without the MBC/OGN commentators, it's not like KeSPA's current sucky commentators will not improve. Anyone remember how horrid OGN's commentators were when BW started airing? Also, it won't take as long for KeSPA's commentators to improve like with OGN given they have something to base their improvements on. Pro Starcraft can run without MBC & OGN. There is already a backup cable station.

I don't think the players & coaches are really speaking their mind due to their sponsors. It's all or nothing especially in the fierce & limited field of Starcraft progaming.

Even with the death of MBC & OGN, in the long run, the benefits outweigh the negatives since Pro Starcraft would be worldwide and in english

I think a lot of people misunderstand about Kespa. Kespa = Proteams. It's made from each representatives of the pro team sponsors. Stop saying, they should make new proleague without kesa, etc.. cuz then there will be only amateurs and OGN/MBC players.

OGN/MBC are pretty much being bullied into making an agreement in Kespa's terms or boycotting the leagues. They are asking about $250,000/yr for each station + 40% profit
from the VOD service which is outrageous. They walked out in middle of MBC's prelims. I think the only reason they didn't walk out on Shinhan Masters is so the MBC/OGN players don't walk out on SuperFight5.

haha, who gave you this idea?

as long as these guys negotiate understanding their limits it is fine, just a redistribution of revenues, but this is being done rather unprofesionally, like a couple of family owned businesses bickering, not at all corporate.

no, the reason they didnt walk out on Shinhan Masters is because Shinhan Bank has put more money into OSL than any other sponsor, and you really do not want to piss off a sponsor like them

OK, this is how I understand this.

IEG owns broadcasting rights.
MBC/OGN do not wish to pay to broadcast.

And this is where it gets interesting. Who boycote who first? If MBC/OGN boycote the proleague first to presure IEG for a lower price, then the fault is on MBC/OGN.

If IEG/proleague boycote MBC/OGN first becuase MBC/OGN didn't accept the offer, then it doesn't make any sense. That's like a news stand owner beat me up becaues I didn't buy his paper.

well, MBC & OGN boycotting ProLeague doesn't effect it much. We had 1 team going anyway -- might as well make it 4. But if KeSPA boycotts OSL & MSL, then OGN & MBC Game are screwed. They will have to make their own separate league with different players, as all the pro teams (and therefore players) belong to KeSPA.

I wouldn't say "beat up" -- just "ignore" you for not buying his paper. And KeSPA can ignore OGN & MBC Game because it isn't being paid. Their contract that they were working on kinda got screwed over on the 16th, so KeSPA is not obligated to go to OSL & MSL. Plus, they are already working on a contract with a 3rd broadcasting company, or so they say.

If the worst case happens, at least OSL and MSL will still have Sparkyz, Hero and eSTRO players, plus Boxer ChRch, HOT, Clon from Army, .. They better take over PantechEX too, so that will make 5 teams, not too bad.
><
KeSPA will have a hard time doing everything by themselves all over again, finding a broadcasting company (with a probably very low contract value) with way much less experience and audiences than OGN/MBC.
I'd say it will not just fck up OGN/MBC but both sides equally, and fck fans the most.

This is just bullshit. OGN/MBC are not obligated to buy the broadcasting for prolegue rights, but kespa boycotts their leagues? Not to mention IEG would be on profit only from reselling the rights to them. Pure idiocy.
I'll call Nada.

Pro league is not going to fall apart. Too much is at stake. Looking at it from a purely economic point of view, it makes sense for someone, be it CJ, OGN or MBC, to negotiate a deal with IEG. It also makes sense for IEG to negotiate a deal because if Proleague doesn\'t exist, then IEG gets nothing.

OGN and MBC do not have as strong a position as they say. They do not have a monopoly on things like technical expertise and commentators. CJ has already stolen several producers from OGN for their Superfight. Whatever commentator a broadcaster needs, it can get.

Also, they don\'t have the moral high ground either if they signed the Proleague rights over to KESPA. KESPA has the right to do whatever they like with them. I produced World Cyber Games on National Geographic, but technically, I need to consult with them everytime I want to pass a copy to my mum. Because it was a full commission. They own the rights to every millisecond of footage I shot. The creator of Superman probably doesn\'t own the rights to Superman either. His company does. Adam West and Burt Ward were the actors who played Batman and Robin in the long running TV series. They\'re not allowed to dress up in costume without permission because no matter how much they helped the character along, they don\'t own the rights. That is the way a capitalist society that respects copyright law functions.

They can count on support from outraged fans for a while. But let\'s face it - a league without Savior? Without Tossgirl? Without Nada? Without Ra? Kingdom? Midas? It\'s just not going to happen. The fans are going to leave.

On the other hand, IEG and KESPA don\'t hold all the cards either. They cannot afford to let Progaming die. Corporations sponsor proteams for publicity, which they are getting a lot of now, of course, but they won\'t if this isn\'t resolved soon.

This is NOT all about making money. That\'s the problem. If it were, we would have reached an agreement by now. This is about egos, about feeling betrayed, about righteous fury. It\'s clouding the scene and making it impossible for a proper agreement to be reached.
