I was completely oblivious to the fact that he left. I only knew of qxc who left.

I know you are just starting out, but its a really serious issue you should handle right now. Apple tried to sue Wapple based on confusion of branding etc. When you approach sponsors and people who dont know you're team, you are going to have this conversation over and over and over again, create confusion for fans, create confusion with brand partners, press, everyone. Just fix it now before you get going. I know you're being constructive and i respect that, but I completely disagree. If Dox was going into production of Graphic Cards, then yes, i'd call that copyright infringement, or if he decided to use the Nvidia logo or tried to associate the team with Nvidia then i would call that infringment. The name is also used for other various companies too. I'm sure Graphics Card Nvidia never tried to sue Exhaust company Invidia or visa-versa. I don't think any serious issues would arise from the naming of team.

I honestly haven't come across that yet, and more often than not, the team is being externally branded/described as Envy (Nv), rather than Invidia, which was my intent.

EG: I don't think we'll be getting sponsored by ATi any time soon with the name "Invidia" for the most extreme example ![]()

![]() I agree with Kennigit though, change your name now before you get started. It's only going to be trouble.

I also think you should change the name, it really shouldn't affect you guys too much currently as you're just starting up ><. Just my opinion though, all the best!

If anything, our name implies association to vehicle customisation, not graphics processors. Please understand the origin of the word before claiming "copyright infringement." ![]()

Just confusion with people who think Nvidia (the graphics card company) picked up some players and added an I to the name.

I'm seriously surprised about you guys who are acting like you're lawyers and saying it's not trademark infringement. If any of you actually are, perhaps it would be a good idea to state that, so we can take your opinion a bit more seriously? IMO it is far from clear cut that there's no infringement. I'm no IP lawyer either, but it's better to be safe than sorry right? Allow me to link some things that might be of some interest: A chapter out of a book by one of Australia's best IP lawyers, SC Shane Simpson: http://www.simpsons.com.au/wp-content/uploads/music_business_3_chapter_011.pdf Before you say, "wait that book is about the music industry", just read the first 3 pages, and ignore anything that specifically relates to music. It applies to any branding, so just extract the key statements from it. Here are some particularly interesting parts: "Don’t assume that you don’t have a problem just because the other user of the name is in a different business or in another geographical area. They may well have the right to stop you from using the name." "If your searches reveal that someone else is using a name identical or even similar to the one you want to use, be careful! Don’t assume that ‘things will be all right’." "In the general law, there is an action called ‘passing off ’, which prohibits any party from misrepresenting itself (or its goods or services) as though it was another. In other words, it prohibits the false appropriation of the other’s reputation." Trade Practices Act s53 regarding false representations: http://www.austlii.edu.au/au/legis/cth/num_act/tpa1974149/s53.html
