You would be suing McDonalds for the incompetence of their employees, mishandling of the law, and whatever price she wants to put on the anger and mental anguish she faced from not getting her McNuggets. it's silly, but that's how it works in this country. when you give somebody money in a purchase, you're supposed to get that item. if you don't, you should get your money back. most of the time, people will accept some sort of substitution, but legally you aren't obligated to: if you pay for something you should get it. obviously this lady overreacted and there's no way you should call the police because of this, a lawsuit or just shrugging off the $5 and going home would have been a better option. by the way, what the fuck is a McDouble, I've never heard of that. | ||

I'm aware of all those, but I don't see the likelihood of that actually sticking in court. Here we employ either tort law or contract law. Tort law requires some damage done to do, and to that end you need to actually prove you've suffered as a result of the employee's negligence. Damage done to her would be in the form of the money (5$), the psychological damage, and the time she wasted trying to get her order. You can't sue someone for incompetence unless that incompetence damaged you in some way.Unless she had a psychology history to back her up, I don't think any judge will even buy her story of "mental anguish", and even then, the liability of the employee would be limited by the fact that it's not something they would expect beforehand. As for the time she spent trying to get her order: since she has time to call the police over mcnuggets I can safely say that the value of her time is limited. Now if we were looking from a contract law perspective, she would be suing for false advertising, but again I am not sure how much money one would actually get out of that because when you break a contract, the amount of payout is still proportional to the monetary value of the objects involved in the contract itself, i.e. the price of 10 McNuggets. You can't sue someone for millions of dollars just because they failed to satisfy a 5$ contract. Seriously, it's not like she was offered McDouble, then choked on the burger or something. THAT might actually lead to some seriously moolah. | ||
