The whole point of creating a corporation is that you are legally protected from the failure of the company. Capitalism, for good and ill, would never have taken over from feudalism if it weren't for the concept of a limited liability corporation. There's a good examination of this in the book "Sapiens: A Brief History of Humankind" by Yuval Harari. So Tim doesn't have to pretend to do anything. He could wind down Frost Giant as a corporation, which is something that will have to happen eventually anyway if they can't report any income for a specified number of years (I think it's three, but I'm not sure if that's universal) and he would suffer no ill effects. It would actually make sense to do this, although it would require relinquishing control over all of Frost Giant's current assets to the bankruptcy court, which include Stormgate itself and its source code, as well as the Snowplay "engine" (for whatever that's worth). It's not clear if anyone would pay anything for these assets, but Tim would likely lose the ability to create a new game using them. One alternative is to use some shady corporate shenanigans, where you start a new company (call it Newco, or maybe be imaginative and call it Fire Dwarf ) and then "sell" all the assets of Frost Giant to Newco before you declare bankruptcy. For bonus points, you can then rename Newco to Frost Giant again. The owners of the Amiga copyrights did this with Amiga, Incorporated, selling the assets to a fake holding company called "KMOS" before renaming KMOS as Amiga Inc. again. One downside of that trickery is that it doesn't relieve you of any existing legal obligations and contracts from the old company. Amiga Inc. did the switcheroo to try and get out of a clause that would have transferred ownership of AmigaOS 4.0 to Hyperion. The latter company sued and won, and the "new" Amiga Inc. eventually dissolved. | ||

Has anyone ever done this? It's pretty clear from Tim's own statements that he is leaning pretty heavily into the idea of a licensed IP for Frost Giant's theoretical next RTS. He claimed that he was "close" to a deal with a publisher for this exact thing, but then it all fell apart. It sounded like the publisher itself didn't get the funding it needed, which would mean Tim wasn't even talking to a real publisher, but a sort of "sub-publisher". Zerospace seems like it's done everything basically right: no dumb free to play nonsense, just pay once and get a game. It seems to have sold well enough (when I checked SteamDB early on it was in the top 200 daily sellers, today it's listed as #597) and as a game it seems reasonably decent. Day9 liked it and had fun with it, even though he pointed out some rough edges. So you've basically got a game that sold okay in Early Access that seems to be fairly good. But in terms of discussion, that can hardly compare with the endless epic train wreck that is Stormgate. | ||
