I think maybe it comes down to a difference in sanity. in addition, americans bitch about signing up for a job with an occupational hazard of getting hit. so when the have head trauma its a lawsuit instead of, "well I did pick this career path" | ||

the issue is player bravado overtaking any sort of desire to look after yourself. i guess the legislation laid down by the league is to take the decision out of the player/team's hands. The issue is that you are asking someone with a head injury to make decisions if they are ok to play(hint, every player is going to say yes). Also the doctors are required by their ethical code to not let players go back onto the field if they are hurt. People can't just fall back on the defense of "The player made the decision, so its their fault." In liability, there is something called comparative negligence that addresses that issue. This is why people hate law. They want it to provide clear, dry, black and white answers to situations. But life isn't like that and law is nothing but nuance and context. 99% of the answers are "maybe?"
